Preliminary and Final Plat Approval for Liberty Construction - 641 Burlington
WHEREAS, Liberiy Construction, has submitted for City Council approval a combined plat for subdivision
of property at 641 Burlington, at the corner of Howard Street, to create five single-family residentiallots; and
WHEREAS, the appropriate City deparhnents have reviewed the plat and found that it meets the requirements
of Chapter b9 of the Zoning Code; and
WHEREAS, notice of a public hearing before the City Council was duly published in the official newspaper
of the City and notices were mailed to each owner of affected property including all property situated witrrin
350 feed of the project property; and
WHEREAS, THE City Council held a public hearing on the proposed plat on November 15, 2004 where all
interested parties were given the opportunity to be heard and the Council considered all the facts and
recommendations concerning the plat;
NOW, THEREFORE, BE IT RESOLVED, that the City Council accepts and approves the combined plat for
Liberty Construction, for creation of 5 single-family residential lots subject to the conditions that:
1. Staking be completed before plat certification;
2. Title amendments be made to lots 1 and 5 to the effect that "City of Saint Paul River Corridar
regulations prohibit development on slopes steeper than 18%."
3. A final, approved tree preservation plan (including filing o£ the necessary performance bond) be
submitted and approved before certification of the plat or before site preparation work commences.

A. PURPOSE: Subdivision by preliminary and final plat at 641 Burlington Road to create five single-
family residential lots.
B. PARCEL SIZE: 67,500 sq. ft. (1.55 acres)
C. EXISTING LAND USE: An abandoned church building
D. SllRROUNDING LAND USE: Single-family residential to the north, east and west. A city park to
the south
E. ZONING CODE CITATION: §69.301 states that platting is required when a subdivision (1) creates
five or more lots or parcels each of which is 2'/2 acres or less in size, or (2) requires paved streets,
alleys and other public improvements, or (3) is previously unplatted land. §69.406 provides criteria
for review of subdivision appiications. §67.200 provides criteria for tree preservation in the
Highwood neighborhood. These criteria are covered below under "Required Findings."
F. HISTORY/DISCUSSION: None found
G. DISTRICT COUNCIL RECOMMENDATION: District 1 Community Councii recommends approval
of the plat with the following request:
- City sets a floor of house values for the development at or above the median house value for
the neighborhood
- The development is in compliance with the Highwood plan and a tree preservation plan is in
place
- Public Works review traffic patterns and possibly adds traffic calming signs at
Oakridge/Howard and Burlington/Howard
H. REQUIRED FINDINGS: § 69.406 of the Zoning Code requires that all of the following findings
shall be made prior to approval of a subdivision:

reviewed the proposed plat and have determined that, subject to the conditions recommended
below, all applicable provisions of city codes are met. §67200 requires a final tree
preservation plan be adopted before final certification of the plat. The prefiminary tree
preservation pian meets the basic requirements of this section. Under the preliminary tree
preservation plan, 31 of 95 trees will be removed and, by code, a minimum of 26 trees must
be planted.
2. The proposed subdivision will not be detrimental to the p�esent and potential surrounding land
uses. The proposed piat is consistent with the surrounding land uses, and will not be
detrimental to present and future use of surrounding land.
3. The area sur�ounding the subdivision can be planned and deve%ped in coordination and
compatibility with the proposed subdivision. The area surrounding the proposed plat is
already developed and compatible with the proposed plat.
4. The subdivision is in conformance with the comprehensive plan. The subdivision is in
conformance with the land use chapter of the comprehensive plan. It is also in conformance
with the Hiqhwood Development Policies and Requlat+ons for Implementation, which ca{Is for
no zoning changes for this area.
5. The subdivision preserves and incorporates the site's important existing natural features
whenever possible. The plat is on a small knoll and two lots (1 and 5} must deal with slopes
of 18% or greater. The developer must understand, and comply with, slope preservation
requirements of the Zoning Code in the placement and construction of buildings. The Ramsey
Soil and Water Conservation District office is concerned about sandy soils and runoff
potentiai. Construction of the site must follow the requirements of Ch 52: Controi of Storm
Water Runoff. Best practices guidance may be found in "Protecting Water Quality in Urban
Areas", "Minnesota Small Site BMP Manual" (Metropolitan Council), and "Erosion Control
Design Manual" (Minnesota Department of Transportation) The plat is also governed by the
Tree Preservation District provisions of the Zoning Code (see below).
6. Al/ land infended for building sites can be used safe/y without endangering residenfs by peril
from f/oods, erosion, continuously high water table, severe soil conditions or othe� menace.
(See #5 above).
7. The subdivision can be economically served with public facilities and services. The
subdivision can be economically served with public facilities and services from Burlington
Road, Howard and Oakridge Streets.
STAFF RECOMMENDATION: Based on required findings 1 through 7, staff recommends
approvai of the finai plat for 5 lots located at 641 Burlington in the area bounded by Burlington
Road, Oakridge Street, Howard Street and an alley subject to the foliowing conditions:
1. Staking be completed before plat ceRification; no delayed staking (monumenting) is allowed.
2. Title amendments be made to lots 1 and 5 to the effect that "City of Saint Paul River Corridor
regulations prohibit development on siopes steeper than 18%"
3. A final, approved tree preservation plan (including filing of the necessary performance bond)
be submitted and approved before certification of the plat or before site preparation work
commences.
4. The applicant file a copy of the Council Resolution approving the plat with the Ramsey County
Recorder's Office.
