1 Wf�REAS, the Council of the City of Saint Paul, upon the petirion of Hamline University, as contained in
2 resolution Council File # 98-627, dated July 8, 1998, approved the vacarion and discontinued as public property,
3 the properiy described in said resolution, attached hereto as "Exhibit A;" and
4 WHEREAS, the City Surveyor has deternuned that the description of said vacated property is inaccurate and has
5 requested it be replaced with a more precise and accurate description; now

THEREFORE BE IT RESOLVED, that Council File #98-627 is hereby amended by deleting the description in
Lines 9 and 10 of "Exhibit A" and replacing it with the following:
The east-west alley and the north-south alley in Brown's Subdivision of I,ots 1 and 4, Block 3,
College Place East Division, lying south of the south line of Pierce Butler Route as opened under
Council File # 186775, approved April 1, 1958.
12 t1ND BE IT FURTHER RESOLVED, that all other terms and conditions set forth in Gouncil File # 98-627 shall
13 remain in full force and effect.

That the petitioner's, their successors and assigns shall pay $500.00 as an administrative fee for
this vacation which is due and payable within 60 days of the effective date of this resolution.
That the petitioners, their successors and assigns shail reconstruct the alley intersection at
Holton Street under ±he orope: pernit zssued by the City of Saint Paul Department of Pubiic
`vVorks.
That the petitioners, their successors and assigns agree to indemnify, defend and save hamiless
the City of Saint Paul, its officers and employees from ail suits, actions or claims of any character
brought as a resuit of injuries or damages received or sustained by any person, persons or
property on account of this vacation or petitioners' use of this property, including but not limited
to, a claim brou�ht becanse of any act of omission, neglect, or misconduct of said petitioners or
because of any claims or liabaliry azising from any violatlon of any law or rewlation made in
accordance with the law, whether �y the petitioners or any of their aQents or employees.
