1 BE IT RESOLVED, that, upon the petition of Emerald Street, LLC, as documented in Real Estate Division
2 File Number 06-2005, public properiy hereinafter described are vacated and discontinued as public property:
3 That part of Ellis Avenue opened and widened per Resolution Ratifying and Confirming Condemnation per
4 Document No. 268663, on file and of record in Ramsey County, Minnesota, lying northerly of the following
5 described line:
6 Beginning at the intersection of the north line of the south 27.00 feet of Lots 25 and 26, Auditor's
7 Subdivision No. 9, Ramsey County, Minnesota, and the east line of Berry Street extended north; thence
8 west on said north line of the south 27.00 feet of Lots 25 and 26, to a point 12.00 feet east of the east line
9 of Emerald Street; thence northwesterly to a point on the east line of Emerald Street 12.00 feet north of
10 said north line of the south 27.00 feet of I,ots 25 and 26 and there said line terminates.
11 BE IT FURTHER RESOLVED, that, this vacation shall be subject to the terms and conditions of Chapter 130,
12 codified March 1, 1981, of the Saint Paul Legislative Code as amended, and to the following conditions:

That the pefitioners, their successors and assigns shall pay $1,200.00 as an administrative fee for this
vacation which is due and payable within 60 days of the effective date of this resolution.
That the petitioners, their successors and assigns shall dedicate to the City of Saint Paul an easement for
street purposes on, over, under and across the following described property:

18 Minnesota lying easterly of the east line of Berty Street extended north and westerly of

Commencing at a point on the north line of Ellis Avenue 181.5 feet west of the
southeast corner of said Lot 25; thence North to a point on the south line of
University Avenue 207.45 feet northwesterly from the northeast corner of said Lot 25
(otherwise described as the West Half of said L,ot 25 in Auditor's Subdivision No. 9).

1 3. That the petirioners, their successors and assigns, shall be responsible for all costs and expenses for the
2 relocation of the existing street light on the north side of Ellis Avenue east of Emerald Street.
3 4_ That the petitioners, their successors and assigns, shall be responsible all costs and expenses for the
4 construcrion and /or reconstruction of the north side of Ellis Avenue from Emerald Avenue to Berry
5 Street, to the sarisfacrion of the Department of Public Works, which shall include, but not be limited to,
6 street pavement, curb, gutter, sidewalk, and boulevard.
7 5. That an easement shall be retained within the vacated area in favor of Northem States Power Company
8 d/b/a Xcel Energy - Electric, its successors and assigns ("Xcel"), far the purpose of maintaining,
9 repairnig and replacing existing overhead electrical line, for so long as Xcel maintains such electrical
10 lines in the vacated area.
11 6. That an easement shall be retained within the vacated area in fa�or of Northern States Power Company
12 d/b/a Xcel Energy - Gas, its successars and assigns ("Xcel"), for the purpose of maintaining, repairing
13 and replacing existing underground natural gas lines, if any, for so long as Xcel maintains such natural
14 gas lines in the vacated area, subject to the following:
15 a) That conshuction of a sidewalk over the existing gas line within this easement area
16 shall be permitted with the understanding that the restoration of the sidewalk due to
17 maintenance, repair or reconshuction of the existing gas line shall be the responsibility
18 of the petitioners, their successors and/ar assigns; or
19 b) That the petitioners, their successors and assigns, shall relocate the gas line into the
20 right-of-way at their own cost and expense.
21 7. That the petitioners, their successors and assigns agree to indemnify, defend and save harmless the City
22 of Saint Paul, its officers and employees from all suits, actions or claims of any chazacter brought as a
23 result of injuries or damages received or sustained by any person, persons or property on account of this
24 vacation or petitioners' use of this property, including but not limited to, a claim brought because of any
25 act of omission, neglect, or misconduct of said petitioners or because of any claims or liability arising
26 from any violation of any law or regulation made in accardance with the law, whether by the petitioners
27 or any of their agents or employees.

1 8- That the petitioners, their successors and assigns shall, within 60 days of the effective date of this
2 resolution, file with the City Clerk an acceptance in writing of the conditions of this resolution and shall,
3 within the period(s) specified in the terms and.conditions of this resolurion, compiy in all respects with

far the vacation of a part of the north 6.0 feet of Ellis Avenue between Emerald Street and
Berry Street as shown of the attached drawing and described on page 2. This inquiry pertains to
the vacation of City right-of-way and release of easements. The petitioner will also be dedicafing
a portion of their property for Ellis Street right-of-way as shown on the attached drawing and as
described on page 3.
Thepurpose ofthis vacationis to allow construction ofprivate storm facilities, steps and landscaping
within this area in juncrion with the Metro Lofts project at 2650 University Avenue W.
Will you please advise me of any concerns you may have regarding this proposed vacation. I would
like to receive your comments by APRIL 12, 2005 so I can prepare a report to the City Council

Nick: In response to your voicemail, I have revised our proposal as follows:
This is to confirm our telephone conference concerning Xcel Energy's objection to our
application for vacation of a portion of Ellis Street:
Our surveyor plotted the gas line in the locations you provided and it appears that the gas line
lies within the portion of the Ellis Street right of way that is NOT going to be vacated. Further,
we do not intend to do any work in Ellis Street or the vacated right of way that would require
excavation to the elevation at which we would be likely to disturb the gas line (2 to 4 feet).
Therefore, we propose to leave the gas line where it is, with the understanding that if the gas
line is in fact within the vacated right-of-way, Emerald Street LLC and Xcel will agree to one of
the following: (1) Emerald Street will grant Xcel Energy an easement to maintain the gas line in
its current location, pursuant to which easement Emerald Street will be responsible for
restoration of teh sidewalk in the event Xcel disturbs the sidewalk in the course of maintaining
the line or (2) Emerald Street LLC will relocate the gas Iine into the right of way at its expense.
Please confirm that this resolution is acceptable by email, with a copy to Tom Beach and Linda
Murphy (you should be able to do this by hitting "Reply to All").

gas main in Ellis Strset in the subject area 4o be vacated (see attached map). Xcel Energy
gas mapping information indicates the gas main to be 32 feet north of the centeriine of EIIis

It may be possible to relocate the affeded gas facilities to a mutually agreed to location as

The City Clerk has refened to tYris office for recommendarion the petition of Emerald Street, LLC
for the vacation of a part of the north 6.Q feet of Ellis Avenue between Emerald Street and
Berry Street as shown of the attached drawing and described on page 2. This inquiry pertains to
the vacaflon of City right-of-way and release of easements. The petitioner will also be dedicating
a portion o€ their property for Ellis Street right-of-way as shown on the attached drawing and as
described on page 3.
The purpose ofthis vacafion is to allow conshuction ofprivate storm facilities, steps and landscaping
within this area in junction with the Metro Lofts project at 2650 University Avenue W.
Will you please advise me of any concems you may have regazding this proposed vacation. I would
like to receive your comments by APRIL 12, 2005 so I can prepare a report to the City Council
on this matter. For your convenience, you will find a fas transmittal memo containing a reply form
attached to this notice. If you would rather respond on your letterhead, please refer to the above
mentioned file number (File #06-2005) when replying.
