1 WFIEREAS, the property owner of 250 West Wheelock Parkway is in need of driveway access over and across
2 an azea of city-owned pazk land known as Wheelock Pazkway, shown on the attached map (Attachment "A"), a
3 copy of which is on file in the Department of Public Works, Real Estate Office, in the file number 07-2005; and
4
5 WHEREAS, the City of Saint Paul, Division of Parks and Recreation ("Pazks") has given permission to the said
6 property owner to conshvct and maintain driveway access over and across said city-owned park land, as stated in
7 the Saint Paul Parks and Recreation Commission's Resolution Numbered OS-09, adopted May 11, 2005, a copy
8 of which is attached hereto; and

10 WHEREAS, said property owner must enter into an agreement with the City of Saint Paul for the construction
11 and continued use of and access to Wheelock Parkway, and pay just compensation to Parks as determined by an
12 independent appraisal pursuant to Section 13.011 of the Saint Paul City Charter; now, therefore be it

RESOLVED, that the proper City officials are hereby authorized and directed to enter into an agreement with
the property owner of 250 West Wheelock Parkway far access to Wheelock Parkway; and be it further
RESOLVED, that just compensation for said access be paid by the owner of 250 West Wheelock Parkway and
deposited into the Parkland Replacement Fund and held in reserve for future purchase of pazk property as
required in Chapter 13.011 of the City Charter, and that any other costs incurred by the City of Saint Paul to
complete any agreement, shall be fully compensated by the property owner.

WF�REAS, tfie Saint Paul Parks and Recreation Commission is an appointed body
established to advise the Mayor and City Council on long-range and city-wide matters related to
Pazks and Recreation; and
WHEREAS, Section 13.011 of the Ciiy Charter requires that the Commission review
any diversion or disposal of pask property and present a recommendation to the Saint Paul City
Council; and
WHEREAS, the City of Saint Pau1, Division of Parks and Recreation, owns city parkway
property known as Wheelock Parkway spanning the city's North End and Payne-Phalen
neighborhaods; and
WI Rita Oberg owns land adjacent to the parkway at 250 Wheelock Parkway
West and has requested the diversion of a 12-foot by 45-foot secrion of the abuttiug parkway for
driveway access (shown as Attachment "A'�; and
W�IEREAS, the TJivision cf Darks aad Recrea �;;r, has dete�,.�ined ;�a: tua parkway
property may be diverted for this purpose and recommends Commission support for the request;
now, therefore
BE IT RESOLVED, that the Saint Paul Parks and Recreation Commission concurs with
the request to divert city park land along Wheelock Parkway West through a license to the
abutting property owner at 250 Wheelock Parkway West, and in accordance with City Charter
Section 13.01.1 recommends approval by the Saint Paul City Cot:acil.

I recoxnmend that a public hearing before the City Council be held on June 15, 2005.
The purpose of this hearing is to consider a resolution to divert city park land abutting 250 West

driveway.
