WHEREAS, property owners adjacent to the Shoreline Strips have petitioned the Boazd to sell
them the Shoreline Strips so that they may have unresiricted access to the shorelines from their
properiy;and
WFIEREAS, the Boazd reviewed the properiy owners' request for said sale and, based upon staff
recommendations, has determined that it does not require fee title interest in the Shoreline Strips
in order to exercise its lake level management rights, but instead requires only access, ponding
and drainage rights over the Shoreline Strips; and
WHEREAS, as a result of said deternunation, the Board did adopt Resolution No. 5027, which
did declaze said fee title interest in the Shoreline Strips to be surplus, which did request that the
City Council of the City of Saint Paul concur with the Board and likewise declare said fee title
interest to be surplus, and which did also request that the City of Saint Paul quitclaim its interests
in the Shoreline Strips in favor of the Board of Water Commissioners so that the Board may
dispose of said surplus fee title interest; now, therefore be it
RESOLVED, that the Honorable Council of the City of Saint Paul does hereby declaze fee title
interest in the above described Shoreline Strips azound Centerville and Peltier Lakes in Anoka
County to be surplus property; and, be it
FURTHER RESOLVED, that the proper City officials are hereby directed to execute a
quitclaim deed which sha11 quit the City's interest in said Shoreline Strips in favor of the Board
of Water Commissioners.

Shoreline Strips so that their properiy would have unrestricted access to the shorelines; and
WHEREAS, the Board has reviewed the properiy owners' request for said sale, and based upon staff
recommendations has determined that it does not require fee ritle to Shoreline Strips in order to exercise its
lake level management rights, but instead requires only access, ponding and drainage rights over the
Shoreline Strips; and
WFiEREAS, as the Board no longer need said fee title, it is willing to sell said feet title to the adjacent
property owners, provided that access, ponding and drainage rights satisfactory to the assistant city attorney
are retained over the Shoreline Parcels; now; therefore, be it
RESOLVED, that the Board of Water Commissioners does hereby deciaze fee title to the above described
Shoreline Strips around Centerville and Peltier Lakes in Anoka County to be surplus property; and, be it
FURTHER RESOLVED, that the Board does hereby request the City Council of the City of Saint Paul to
concur with the Board and to declare said fee title ownership of the Shoreline Strips to be surplus property;

FINALLY RESOLVED, that the Board does hereby request that the City of Saint Paul quitclaim any and all
interests it may hoid in said Shoreline Sirips in favor of the Board of Water Commissioners.

WHEREAS, property owners adjacent to the Shoreline Strips have petitioned the Boazd to sell
them the Shoreline Strips so that they may have unresiricted access to the shorelines from their
properiy;and
WFIEREAS, the Boazd reviewed the properiy owners' request for said sale and, based upon staff
recommendations, has determined that it does not require fee title interest in the Shoreline Strips
in order to exercise its lake level management rights, but instead requires only access, ponding
and drainage rights over the Shoreline Strips; and
WHEREAS, as a result of said deternunation, the Board did adopt Resolution No. 5027, which
did declaze said fee title interest in the Shoreline Strips to be surplus, which did request that the
City Council of the City of Saint Paul concur with the Board and likewise declare said fee title
interest to be surplus, and which did also request that the City of Saint Paul quitclaim its interests
in the Shoreline Strips in favor of the Board of Water Commissioners so that the Board may
dispose of said surplus fee title interest; now, therefore be it
RESOLVED, that the Honorable Council of the City of Saint Paul does hereby declaze fee title
interest in the above described Shoreline Strips azound Centerville and Peltier Lakes in Anoka
County to be surplus property; and, be it
FURTHER RESOLVED, that the proper City officials are hereby directed to execute a
quitclaim deed which sha11 quit the City's interest in said Shoreline Strips in favor of the Board
of Water Commissioners.

described as follows: to wit; commencing at the northwest corner of the northeast quarter (NE'/4)
of said section fifteen (15) thence n»,ning east one hundred twenty (120) rods to lake Peltiex thence
n,nn;ng at right angles south twenty one and one third (21 1/3) rods thence at right angles west one
hundred twenty (120) rods to the center line n�nning north and south through said section fifteen

All subject to final survey; and
WHEREAS, the City of Saint Paul holds said fee title ownership interest in the Shoreline Strips for the
benefit of the Board of Water Commissioners (the "Board") for the Board's lawful management of
Centerville and Peltier lake levels; and
WIIEREAS, properly owners adjacent to the Shoreline Slrips have petitioned the Board to sell them the
Shoreline Strips so that their properiy would have unrestricted access to the shorelines; and
WHEREAS, the Board has reviewed the properiy owners' request for said sale, and based upon staff
recommendations has determined that it does not require fee ritle to Shoreline Strips in order to exercise its
lake level management rights, but instead requires only access, ponding and drainage rights over the
Shoreline Strips; and
WFiEREAS, as the Board no longer need said fee title, it is willing to sell said feet title to the adjacent
property owners, provided that access, ponding and drainage rights satisfactory to the assistant city attorney
are retained over the Shoreline Parcels; now; therefore, be it
RESOLVED, that the Board of Water Commissioners does hereby deciaze fee title to the above described
Shoreline Strips around Centerville and Peltier Lakes in Anoka County to be surplus property; and, be it
FURTHER RESOLVED, that the Board does hereby request the City Council of the City of Saint Paul to
concur with the Board and to declare said fee title ownership of the Shoreline Strips to be surplus property;
and, be it
FINALLY RESOLVED, that the Board does hereby request that the City of Saint Paul quitclaim any and all
interests it may hoid in said Shoreline Sirips in favor of the Board of Water Commissioners.
