WHEREAS, Neighborhood Housing and Property Improvement (NHPI} has requesfed fhe City
Council to hold public hearings to consider the advisability of revoking the rental registration certificate
for a single family rental property located at 1968 GRAND AVE and registered to Michael J. Fitzgerald ;
and
WHEREAS, on October 5, 2004, Department of Fire and Safety Services conducted an
inspection of said properry and issued Orders with a compliance deadline of October 15, 2004; and
WHEREAS, on October 21, 2004, Department of Fire and Safety Services conducted a
reinspection of said property and reissued orders a complaint deadline ofNovember 22, 2004 (Extensions
were granted); and
WHEREAS, On May 5, 2005, Department of Fire and Safety Services conducted a reinspection
of said property and issued Condemnation orders with a compfiance deadline of May 12, 2005.
WHEREAS, on May 13, 2005, NHPI sent Michael J. Fitzgerald the proper Notice of Intent to
Revoke Rental Registration (copy attached}; and
WI-IEREAS, Michael J. Fitzgerald has not appealed said notice and the time for filing an appeal
has expired; now therefore
BE IT RESOLVED, that based on the foregoing, the Saint Paul City Council hereby adopts the
following findings and order concerning the subject property at 1968 GRAND AVE .

That the subject property is a single family rental property that is required to be registered
with the City's Rental Registration Program
That the holder of the Rental Registration Certificate for the subject property is Michael J.
Fitzgerald .
That this subject property is under CondemnaYion Orders.
That the ttotification requirements of Chapter 51 have been fulfilled and the tnne for an
appeal has e�cpired without an appeal being made.

I am writing to you in your capacity as the hoider of a rental registration certificate for 1968 GRAND AVENUE
, St. Paui MN.
You aze hereby notified, pursuant to the authority granted to me under Chapter 51 of the St. Paul Legislative
Code, of the City's intent to revoke the registration certificate for 1968 GRAND AVE base�l on the following:
On October 5, 2004, Department of Fire and Safety Services conducted an inspection of said
property and issued Orders, with a oompliance deadine of October I5, 2004.
Z, On October 21, 2004, Department of Fire and Safety Services conducted a reinspection of said
property and reissued orders with a complaint deadline ofNovember 22, 2004 (Extensions wer�
granted).
3. On May 5, 2005, Department of Fire and Safety Services amducted a reinspection of said
property and issued Condemnation orders with a comptiance deadline of May 12, 2005.
I have referred this matter to the St. Paul City Council with a recommendation to revoke the rental registrati�
certificate. The City CounciI w�l revoke unless an appeat is filed in the next thirteen (13} days from the date
this notice. An appeal may be filed pursuant to legislative Code § 18.02, by appearing in person between the
hours of 8:00 a.m and 430 p.m on any business day at the City Clerk's Office, Room 170, City HaII, 15 4�
Kellogg Boulevard, St. Paul, MN or you may appeat by mail within the same 13 day time line.
Once the City Councii has revoked the rental registration certificate, occupancy of the property is not allo�
until {1) an inspection by Neighborhood Housing and Property Improvement (NHPI} has been conducted,
Director of NHPI has detern�ined the property to be in compiiance, and {3) the certificate is renewed. No'
Renting a property without a certificate is a misdemeanor.
