RESOLVED� upon the pertinent appeal under the Zoning .
Code by Herbert Nilson� as owner of the subject property
situate in the City of Saint Paul, described as Lot l,
Block l, Nininger & Donnellyts Addition to Holcombe� s
Addition to Saint Paul� located at the southwest corner
of Marshall Avenue and Grotto Street, that the provisions
of said Zoning Code hereby are determined and varied in
application so that the premises may contain separate
accommodations for several, not in excess of four families, pro-
vided that the continuance of such four-family dwelling be for
the remaining life of the structure now m said premises� and
provided further, that the appellant comply with the changes
� set forth in the Bureau of Publie Buildings and Housing Code
Division report dated January 4, 1966, and provided further,
that such permission shall lapse ipso facto unless the
appellant is in full compliance with the above report, dated
January 4, 1966, within one year from the date of this
resolution� and provided further, that the appellant provide
a total of four off-street parking spaces for said dwelling.;,
acceptance of this resolution and terms to be made by the
. appellant, and subject to compliance .with said provisions �-�-�

" This is written in response to the Appeal of Herbert Nilson to
legalize and continue an existing illegal,- four-family use on
property classified in' a "B" Residence district. •The property
is on the� southwest corner of Marshall Avenue and Grotto Street,
described as Lot l, Block l, Ninninger. � Donnelly's Addition to
Holcombe's Addition. The �existing structure on the property was
- constructed in 1900 with the ground area as delineated by its
foundation in excess of 1,000 square feet. At some later date
the structure was extended without authorization to a four-family
use. Since the property is classified as "B" Residence which .
limits'it to a one-and two-family use, the applicant must secure ,
- Council authorization pursuant to Chapter 6�4.03, sec. o, par. 2,
, of the Legislative Zoning Code to continue the use of the pro-
� perty, as a four-plex. .
The Board of Zoning he.ard this request on February 3, 1966. It
was the Board's findings that it would be reasonable to permit
the four-family use to continue for the remaining life of the
structure provided that the applicant compl'y with the changes as
set forth� in the Bureau of Public Buildings and Housing Code
. Division report, dated January 4, 1966, a copy of which is � �
attached, and further provided that four off-street parking
. sp aces are developed on the property., It is also the Board of .
� , Zoning's recommendation tha't, should�the Council grant the Appeal,

The following is a list of items requiring alteration, repair or
removal to meet the minimum requirements of the Housing Code and
Building Code.
1 . Enclose the boiler room with materials having a fire
resistant rating of at least one hour.
2. Install a handrail on the basement stairway.
3. Replace the hatchway stairs .
4. Repair the hatchway door.
5. Install a relief valve on the hot water heater.
6. Install vents on the laundry tub, water closet, bathtub
and lavatory in the basement.
7. Make the proper connection from the L" lead waste from
the first floor sink where it present�y is pushed into
a piece of 1%" black steel pipe:
8. Replace the 3/8" copper gas line serving the kitchen
range on the second floor with materials meeting the
Code requirement. '
9. Install a vent on the kitchen sink on the first floor.
10 . Install a shut off stop on the gas range connection.
11 . Remove the hand lavatory and install a conventional dish-
washer sink in Apt. 2 on the second floor.
12. In the south apartment on the second floor, properly
• connect the sink waste and re-install the vent for the
bathtub.

13. Install the proper fusing in the branch circuits. Re-
move the BX wiring system as used in the basement and
install the proper receptacle for the use of laundry
equipment.
14. Install an additional outlet in the first floor dining
room and remove the extension cords presently used in
the kitchen.
15. Install an additional receptacle in the kitchen of
Apartment 1 on the second floor and in the kitchen of
Apartment 3. Remove the extension cords that are
presently serving as additional outlets.
