RESOLVED� upon the pertinent appeal under the Zoning
Code by Marlyn Parsons, as owner of the subject property
situate in the City of Saint Paul� described as Lots 16 and
17, B lock 1, Nininger and Donnellyts .�lddition to Holcombe' s
Addition to Saint Paul, located on the north side of Dayton
Avenue between Avon and Grotto Streets� that the provisions
of said Zoning Code hereby are determined and varied in
- application so that the premises may contain separate
accommodations for several� not in excess of four families�
provided that the continuance of such four-family dwelling
be for the remaining life of the structure now on said
premises, and provided further� that the appellant comply
with the changes set forth in the Bureau of Public Buildings
and Housing Code Division report dated December 22� 1965� and
provided further� that such permission shall lapse ipso facto -
unless the appellant is in full complia�ce with the above
report, dated December 22� 1965, within one year from the date
of this resolution� and provided further� that the appellant
provide a total of four off-street parking spaces for said
dwelling, acceptance of this resolution and terms to be made
by the appellant, and subject to compliance with said
provisions the Council expressly finds that such relief will
be consistent with the_ public health and general welfare, and

further condition that the appellant and his successors and
assigns otherwise shall make due compliance with all applicable
provisions of Municipal Ordinances� State Statutes, rules and
regulations of� public authorities having cognizance; further�
that a copy of this Resolution be filed with the Register of
Deeds in and for Ramsey County, Minnesota.

This is written in response to the Appeal of Marlyn Parsons to
legalize and continue an� existing, illegal, four-family use on
property classified as "B" Residence. The property-is located
on the riorth side of Dayton Avenue between Avon and Grotto
Streets, described as Lots 16 and 17, Block 1, Nininger and
- Donnelly's Addition. -
In 1897 the existing structure was constructed with a ground
- area delineated by its foundation of 1,193 square feet. At
• some later date the structure was extended without authoriza- ,
tion to a four-plex. Because the property is classified as
"B" Residence which would restrict it to a two-family use, the '
applicant must secure Council authorization under Chapter 64.03, �
sec. o, par. 2, of the Legislative Zoning Code to continue the
four-family use.
The Board of Zoning heard this request on February 3, 1966. It '
was the Board's findings that it would be reasonable to permit .
� � the four-family use to continue for the remaining life of the
structure provided that the applicant comply with the changes
, as set forth in the Bureau of Public Buildings and Housing Code
Division report dated December 22, 1965, a copy of which is
, attached, and further provided that four off-street parking
spaces are developed on the property. It is also the Board's
� � recommendation that, should the Council grant the Appeal, a .
copy of the resolution be filed with the deed to said property
� in the office of the Register of Deeds.

11 . Provide the rec{uired vents for these plumbing fixtures -
the laundry tub, bath-tub and lavatory on the first floor
bathroom, the sink on the second floor in Apt. 2 and
for the lavatory in Apt . 3.
12. The third floor of this building is not to be used for
habitable rooms ; however, the bathroom now existing on
the third floor may remain and may be kept in service
if it has been ventilated as previously mentioned.
