successors and assigns, otherwise� shall make due compliance with
all applicable provisions of municipal ordinances� State statutes

This is written in response to the AppeaT of Fisher Real Estate
to relax the height restxictions on property located in Height
District I. The property_.is located at the northwest corner of
Wycliff and Bradford Streets,, described as Lot 1 and Lot 2,
� except that portion of Lot.2 deeded to the City of Saint Paul
for alley and'street purposes pursuant to Council File 139860
- under deed dated May 20, 1947, and recorded in the office of the .
Register of Deeds� of Ramsey County, Minnesota, on July 7, 1947,
in Boolc 1251 of Deeds, page 359 and the vacated alley lying
between Lot 1 and Lots 24, 25, and 26, all in Block 69, Saint
Anthony Park, according to the plat thereof on file and of
record in the office of the Register of Deeds of Ramsey County,
Minnesota.
At the January 20, 1966 Board of Zoning meeting, the staff � _
reported that Height District I limits the height of buildin.gs
• - to 40 feet and that the appellant wishes to construct an addi- "
' tion to its present building to a height of 71 feet, 8 inches.
The zoning surrounding the area is Heavy Industry.
It was the..findings of the Hoard that the proposed height of
_ the addition would have no detrimental effect on surrounding
property and since expansion space is limited in the area
� recommends approval of the Appeal to relax the height limitations.

f) The proposed use of the property is for the construc-
tion of a- five-story industrial, manufacturing and general
office building for lea�se to the Fisher Nut Company division
of Bea.trice Foods Co. The proposed building will have a
frontage of 110 feet on,Wycliff a�nd a depth of 80 feet. Its
southerly exposure on Wycliff and its westerly exposure will
be of concrete a�nd face brick a�nd on the easterly side it
will be annexed to the existing building now located at the
corner of Wycliff and Bradford, presently under lease .from the
applicant to �he Fisher Nut Compa.ny. The building will have
a�. elevation of 75 feet from the ground level on Wycliff to
the top of the roof parapet, the heights of the various floors
being as follows :
Basement - 9' 8", of which �-' 6" projects a�bove the

h) _ The appeal is needed, because a.lthough the property
a�foredescribed is zoned '�heavy industry" it is within Height
District I, and the height of the proposed 'building, a.s above
indicated, is in excess of the height permitted in Height
District I under Section 61.02 of Chapter 61 of the Legisla-
tive Code,
2) The site of the proposed building is vaca.nt and there
