I WHEREAS, William H. Van Ort, an�r'employe of the Department
of ', Parks, Recreation and Public Buildings was in�ured in :an �
accident on January 1, 1g63, wh3.1e engaged in the performance of
his duties, for said Depar�ment, and
' Wi-�REAS, the City has incurred medical expense in �he amount
, of' $335•00 �herefor, and said employee was disabled for work for
a period �of time, being paid salary in the amount of $1086 .25;
, and the City squad car No.� 73� was also damaged in said accident
t.o�.the extent of $2,01�F.30 for which Comptroller's regiatered
bill 3-2086 was issued; and
WHEREAS, a settlement has been negotiated between said employe
and the other party involved in said accident, in the total amount
of $�+200.00, $1200.00 of which is credited to the claim of the
City, the issuea of negligence and proximate cause being in doubt;
and
WHEREAS, independen� counael, Paul A. Joyce, Jr. has represen�ed ,
the ��ity in its subrogation claim and in its property damage claim
upon the agreed fee of 25� of the amount recovered on behalf of the
City, to wit : $300.00; now, therefore, be it
' RESOLVED, That the proper City Officers are hereby authorized
to�, accept in full final and complete settlement of its claim
herein the sum of $900.00 and �to execute any necessary releases
therefor; that of said sum, $215 .00 will be credited to the Parks
Receipt Fund 0-7�9R; $335•00 to the Worl�rnieri's Compensation Fund;
� and�35o.00 to full compromise and settlement of the registered bill
� 3=2 6, and cancellation of the balance .
