2 WHEREAS, Chapter 293 of the Saint Paul Legislative Code was enacted to regulate the subject of noise in
3 the City of Saint Paul; and

5 WHEREAS, §29311 provides for the granting of variances from the sound level limitarions contained in
6§293.09, upon a finding by the City Council that full compliance with Chapter 293 would constitute an
7 unreasonable hardship on an applicant, other persons or on the community; and
8
9 WHEREAS, Minnesota Music Cafe, represented by Bill Larson, co-owner, who has been designated as the
10 responsible person on the application, has applied for a variance to allow amplified music at 499 Payne Ave., on
11 June 10 and 11, 2005; and

13 WHEREAS, appiicant is seeking a variance for the hours of 7:00 p.m. to 12:00 A.M. the nights of June 10
14 and 11; and
15
16 WHEREAS, if applicant is not granted a variance it will not be able to present the amplified music-; and
17
18 WHEREAS, the Office of License, Inspections, and Environmental Protecrion has reviewed the application
19 and has made recommendarions regarding conditions far the variance; now, therefore, be it

RESOLVED, that the Council of the City of Saint Paul hereby grants a variance to Minnesota Music Cafe,
subject to the following conditions:
i) The Office of LIEP recommends that the variance shall be for the hours of 7:00 p.m.
to midnight on June 10 and 11, 2005.
2) All electronically powered equipment used in conjunction with the event shall not
exceed 90 dbA as measured at either the cioser of the sound mix or 50 feet from the
stage.

2 3) The applicant shall provide personnel and equipment who shall provide continuous
3 sound level monitoring between 7:00 p.m. and midnight on June 10 and 11.

5 4) All electronically powered equipment, PA systems, loudspeakers or similar devices shall be turned
6 off no later than the set time on each of the dates.
