1 WHEREAS, Neighborhood Housing and Property Improvement (NHPI) has requested the City
2 Council to hold public hearings to consider the advisability of revoking the rental registration certificate
3 for a duplex rental property located at 282 AURORA AVE and registered to Chou Chue Tchang; and

5 WHEREAS, on Mazch 14, 2005, NHPI conducted an inspection ofsaid property and issued a
6 Correction Notice with a compliance deadline of Mazch 21, 2005; and

WHEREAS, on March 21, 2005, NHPI conducted a reinspection of said property and found lack
of compliance with the previous order; and
WHEREAS, on March 22, 2005, NHPI sent the holder of the rental registration certificate for the
subject property, Chou Chue Tchang, a$50 excessive consumption bill, addressed to 565 Kent St, St
Paul MN 55103-2304, the address on said certificate; and
WHEREAS, as of May 12, 2005, said $50.00 has not been paid, and Legislative Code §51.06 (a)
(v) provides that non-payment of fees far excessive consumption is grounds for certificate revocation;
and
WHEREAS, on Mazch 22, 2005, NHPI notified Chou Chue Tchang of the need to arrange an
interior inspection of the subject property, and
WHEREAS, as of May 12, 2005, an interior inspection has not been arranged, and Legislative
Code §51.07 (a) (iri) provides that the imposition of an excessive consuxnption fee is grounds for an
interior inspection; and
WHEREAS, on Apri128, 2005, NHPI sent Chou Chue Tchang the proper Notice ofIntent to
Revoke Rental Registration (copy attached); and
WHEREAS, Chou Chue Tchang has not appealed said notice and the time for filing an appeal has
expired; now therefore
BE IT RESOLVED, that based on the foregoing, the Saint Paul City Council hereby adopts the
following findings and order concerning the subject property at 282 AURORA AVE .
That the subject property is a duplex rental property that is required to be registered with
the City's Rental Registration Program.

2. That the holder of the Rental Registration Certificate for the subject property is Chou
Chue Tchang.
T'hat said certificate holder has been billed for excessive consumption of code inspection
services, wluch has not been paid.

That said certificate holder has been requested to allow an interior inspection of the
subject property, which has not been arranged.

That the notification requirements of Chapter 51 have been fulfilled and the time for an
appeal has eapired without an appeal being made.

The Saint Paul City Council hereby xnakes the following order:
The above-referenced Rental Registration Certificate issued to Chou Chue Tchang for the
duplex rental property at 282 AURORA AVE, Saint Paul, MN is hereby revoked.
1.
It is further ordered that a copy of this resolution be mailed to Chou Chue Tchang.

I am writing to you in your capacity as the holder of a rental registration certificate for 282 AURORA AVE ,
St. Paul MN.
You aze hereby notified, pursuant to the authority granted to me under Chapter 51 of the St. Paul Legislative
Code, of the City's intent to revoke the registration certificate for 282 AURORA AVE based on the following:

On Mazch 14, 2005, this department conducted an inspection ofsaid property and issued a
Correction Notice with a compliance deadline of March 21, 2005
On March 21, 2005, this department conducted a reinspection of said property and found lack of
compliance with the previous order.
On Mazch 22, 2005, this department sent you a$50.00 bill for the cost ofsaid reinspection.
As of today this $50.00 has not been paid.
On March 22, 2005, this department notified you by mail of the need to arrange an interior
inspection of said rental property.
As of today this interior inspection has not been arranged.
I have referred this matter to the St. Paul City Council with a recommendation to revoke the rental registration
certificate. The City Council will revoke unless an appeal is filed in the next thirteen (13) days from the date of
this notice. An appeal may be filed pursuant to legislative Code §18.02, by appearing in person between the
hours of 8:00 am and 430 p.m on any business day at the City Clerk's Office, Room 1'70, City Hall, 15 W.
Kellogg Boulevazd, St. Paul, MN or you may appeal by mail within the same 13 day time line.

Once the City Council has revoked the rental registration certificate, occupancy of the property is not allowed
until (1) an inspection by Neighborhood Housing and Property Improvement (NHPI) has been conducted, (Z) the
Director ofNHPI has determined the property to be in compliance, and (3) the certificate is renewed. Note:
Renting a property without a certificate is a misdemeanor.
Please call me as soon as possble to arrange a meeting to discuss how to wrrect this situation before the City
Council acts to revoke this certificate. If all issues are addressed, I will recommend that the revocation be
withdrawn from wnsideration by the City CounciL
