emergency ordinance rendered necessary for the
preservation of the public peace, health and safety.
THE COUNCIL OF TH� CITY OF SAIIdT FAUL DOES ORDAIN: � \�
SECTION 1 '
That Chapter 241 of the Saint Faul Legislative Code be
and the same is hereby repealed and the following is hereby
substituted in lieu and in place thereof to be known as
Sanitary Disposal:
241 Sanitary Disposal �
"241.01. No person shall exercise, carry on or be
engaged in the trade or business of Sanitary Disposal within
,-.�- the Corporate limits of the City of Saint Paul without first
having obtained a license so to do as herein provided. For
• the purpose of this Chapter, the trade or business of Sanitary .�
�' Disposal shall be defined as the cleaning and removing the
contents of any septic tank, cesspool, sink, privy vault,
and other private drain. The annual license fee shall be
$30.00 and the license shall expire on June 30. The application
.: for license shall be made with the Sewer Permit Clerk of the
- Department of Public Works. The license fee shall be paid to
the City Clerk and payment receipt returned to the Sewer Permit
Clerk who will issue the license."
"241.02. No person shall discharge or dispose the
contents of any septic tank, cesspool, sink, privy vault,
, � and other private drain into the Minneapolis-Saint Paul
Sanitary Interceptor System located within the City of
Saint Paul without first having obtained a permit so to do f rom
the Department of Fublic Works. The permit shall expire on June
30. This provision shall not apply to any person who is
currently licensed pursuant to this Chapter."
"241.03. Before the�issuance of any license or permit as
provided herein, the applicant shall execute and submit to the
�ewer Permit Clerk of the Department of Fublic Works, who in
' turn will file with the City Comptroller�n annual bond in the
sum of $5,000 running to the City of Saint Paul, which bond shall be ,
approved as to form and execution by the Corporation Counsel, and
, by the Commissioner of Finance as to the surety thereon. Such bond
� . shall be conditioned that the said licensee or permittee shall perform the
work for which he is licensed or permitted in an approved sanitary
manner in accordance with the provisions of this Chapter and all
regulations of the Bureau of Health and the Department of Fublic Works,

and that he shall pay for all labor performed and materials
furnished in the performance of such work, and shall save the
City of Saint Paul harmless in the premises."
"241.04. No licensee or permittee shall use or �
operate on any public street or highway in the City of Saint
Paul any vehicle used for the purpose of conveying contents
of any septic tank, cesspool, sink, privy v�ault, and other
private drain without first having obtained a vehicle �
license as herein provided:
- "a) The annual license f ee for each vehicle shall
be $50.00 and the license shall expire on June 30.
Vehicle licenses shall be obtained from the Department
of Fublic Works. The license fee shall be paid to the
City Clerk and payment receipt returned to the Sewer
Permit Clerk who will issue the license." �
"b) There shall be issued to the owner of each and
every licensed vehicle a suitable license tag which shall
be fastened and displayed upon the outside of each and
, every vehicle so that said license tag may be plainly
visible at all times. In case any vehicle licensee shall
lose his license tag, he sh.all forthwith and before doing
w , any further business procure a new license tag and shall
� pay for each new license tag the sum of $1.00."
, "c) The license applicant shall take out and maintain
, during the period of the vehicle license comprehensive
protective public liability insurance for and in behalf of
himself and the City of Saint Paul as joint insureds, and
using a cross liability endorsement, protect the City and
, - the licensee from claims for damages and bodily injuries,
� including accidental death, as well as from claims for
' � property damage which may arise from operations involving
all phases of sanitary disposal, and copies of such policies
shaTl be filed with the application for vehicle license.
The approved liability insurance policies shall be filed
by the Sewer Permit Clerk with the City Comptroller. Such �
policy shall have a condition that it cannot be cancelled
after a loss has occurred under the policy which will affect
the company� s responsibility therefor under this Chapter; and
in case of any cancellation the license shall automatically
become inoperative and void, unless another policy is
forthwith issued, approved and filed in lieu of such cancelled
policy. The minimum amounts of such public liability
insurance shall be as follows:

Bodily injury insurance (including death)
in an amount of not less than �250,000 for
all damages arising out of b6dily injuries
to or death of one person, and subject to
the same limit for each person in a total
of not less than 5500,000. on account of any
one accident.
Property damage insurance in an �amount of
not less than $150,000 for all damages to or =
destruction of property in any one accident.
"d) At no time will it be permissable to transfer
lic�nses f rom one vehicle to another without consent of
the Department of Public Works. No vehicle shall be �-
, sold or transferred without first removing the license
tab f rom the vehicle and destroying it.
"241.05. The cleaning, emptying and removing of the contents
of any septic tank, cesspool, sink, privy vault, and any other
private drain shall be done in an inoffensive manner, and any
person having begun any such sanitary disposal work shall, without
• any interruption or delay, finish the same; and shall in every instance
leave the septic tank, cesspool, sink, privy vault, and private
drain in as good condition upon the outside as when the work was
undertaken.
"241.06. Every licensee or permittee hereunder in conveying _
upon the public streets, alleys, or elsewhere in the City of Saint
Paul, the contents of any septic t&nk, cesspool, sink, privy vault,
or private drain, shall convey the same in a tank approved by the
Bureau of Iiealth, and in such a manner as to avoid overloading or
spilling the contents thereof, or the emission of an offensive odor
theref rom, and shall maintain the exterior of the vehicle and tank in
a clean. manner. If any of the contents of the tank shall be spilled
or fall upon, any street, walk or premises, the owner or driver of the
vehicle shal�l replace the same immediately and remove all traces thereof.
The tanks shall be kept and maintained clean and inoffensive when
not in use.
"241.07. No person shall dispose or discharge the contents of
any septic tank, cesspool, sink, privy vault, or other "private
drain, within the City of Saint Paul, in any manner other than by V
disposing or discharging the same into the Minneapolis-Saint Paul
Sanitary Interceptor located in the vicinity of East 3rd. Street and
Commercial Street; and said contents shall be so disposed or discharged
in compliance with the regulations of the Bureau of Health and the
Department of Fublic Works.

"241.08. All persons licensed hereunder shall keep an
accurate record of the ntame and address of the owner of each
septic tank or cesspool which is pumped, and said licensee
shall submit to the Commissioner of Public Works, on the first
day of each month, a written report listing the�name and
address of the owner of the property containing the septic
tank or cesspool pumped by said licensee. - '
"241.09. .
a) All licenses issued pursuant to this Chapter
between January 1, 1967, and June 30, 1967, shall
be issued at one-half the prescribed rate, and said ,...-
licenses shall expire on June 30, 1967. �
b) The provisions of Section 4 of this Chapter
shall not be applicable to any person currently
licensed as a scavenger; however, upon expiration thereof
and upon application f or renewal being made pursuant
to this Chapter, all provisions of said Section 4 shall
be complied with." , �
SECTION 2
This ordinance is hereby declared to be �n emergency ordinance
rendered necessary for the preservation of the public peace, health
� and safety.
, SECTION 3
This ordinance shall take effect and be in force from and after its /
passage, approval and publication.
