Dre�er III ; and 4 5 WHEREAS, on March 31, 2005 Saint Paul police executed search warrants sitnultaneously on 6 both the lower and upper rental units at 28'7 Burgess Street. Police arrested Danny McLaurin and 7 Chavonia Neal, residents of the lower unit, for possession of a controlled substance with intent to sell. 8 During a search of the lower residence police recovered a significant amount of suspected "crack" 9 cocauie as well as a large amount of cash (over $3,000).; and 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 33 34 35 36 37 38 39 40 WHEREAS, at the same time, police officers recovered suspected "crack" cocaine in two different locations during the execution of the search warrant for the upper residence. Resident Mary Neal was arrested after a brief struggle and was charged with possession of a controlled substance with intent to distnbute; and WHEREAS, Legislative Code §51.06 (a) (ri) provides that a detern�ination by the Director of Neighborhood Housing and Property Improvement that use and occupancy of that dwelling constitutes a nuisance and provides further that such is grounds for revocating a rental registration certificate; and WHEREAS, on April 18, 2005, NHPI sent William E. Dreicler III the proper Notice of Intent to Revoke Rental Registration (copy attached); and WHEREAS, William E. Dre�er III has not appealed said notice and the time for filing an appeal has expired; now therefore BE IT RESOLVED, that based on the foregoing, the Saint Paul City Council hereby adopts the following findings and order concerning the subject property at 287 BURGESS ST . 1. 2. 3. 3. That the subject properiy is a duplex rental property that is required to be registered with the City's Rental Registration Program. That the holder of the Rental Registration Certificate for the subject property is William E. Drexler III. That use and occupancy of the subject property has constituted a nuisance and continues to be a nuisance. That the notification requirements of Chapter 51 have been fulfilled and the time for an appeal has expired without an appeal being made. You aze hereby notified, pursuant to the authority granted to me under Chapter 51 of the St. Paul Legislative Code, of the City's intent to revoke the registration certificate for 287 BURGESS ST. Based on the following facts I have determined that the use and occupancy of 287 BURGESS ST constitutes a nuisance: 1. On Mazch 31, 2005 Saint Paul police executed seazch warrants simultaneously on both the lower and upper rental units at 287 Burgess St. Police arrested Danny McLaurin and Chavonia Neal, residents of the lower unit, for possession of a controlied substance with intent to sell. I have referred this matter to the St. Paul City Council with a recommendation to revoke the rentai registration certificate. The City Council will revoke unless an appeal is filed in the next thirteen (13} days from the date of this notice. An appeai may be filed pursuant to legislative Code §18.02, by appearing in person betsveen the hours of 8:00 a.m, and 4:30 p.m. on any business day at the City Clerk's Office, Room I 10, City Aall, 15 W. Kellogg Boulevard, St. Paul, MN or you may appeal by mail4vithin the same 13 day time line. Note: Renting a properry without a certificate is a misdemeanor. Please call me as soon as possible to arrange a meeting to discuss how to' correct this situation before the Ciry Council acts to revoke this certificate. If all issues aze addressed, I will recommend that the revocation be withdrawn from consideration by the City Council.
