2 WHEREAS, the City, pursuant to planning commission resolutions no.'s OS-13 and OS-
3 14, each dated February 11, 2005, has assembled a task force and initiated a"40 acre study" for
4 the L.oeb Lake area in the City's North End as set forth on the map entitied "Loeb Lake Small
5 Area Plan and Zoning Study" (hereinafter, "the Study Area") and attached hereto and
6 incorporated herein by reference as Exhibit A; and

8 WHEREAS, the City's planning process for the Study Area will address various
9 redevelopment opportunities and recommend appropriate zoning classifications and development
10 guidelines for the redevelopment and transformation of the Study Area and to incorporate those
11 classifications and guidelines into the City's comprehensive plans and official controls; and

13 WHEREAS, some existing or former commercial and industrial uses and some present
14 zoning classifications within the Study Area may allow development in the near term which
15 would be incompatible or inconsistent with any long term goals recommended and adopted by
16 the City based upon the planning process initiated under the said planning commission
17 resolutions noted above; and

19 WHEREAS, the potenual for incompatible or inconsistent development within the Study
20 Area raises substantial quesrions relating to the ability of the City's present official controls to
21 provide compiiance with the longer term redevelopment and transformation goals for the Study
22 Area as well as the comprehensive plan; and

WHEREAS, because the planning process for the Study Area is incomplete and for the
purpose of preserving the status quo regarding land use in the study area, and far the purpose of
preserving the public's health, welfaze and safety pending the conclusion of the said study, the
Council of the City of Saint Paul desires to immediately temporarily prohibit development on any
parcel of land or part thereof within the Study Area depicted on Exhibit A, until such time as the
aforementioned study has been completed and presented to the planning commission and the
Council has taken action on any recommendations contained therein:
NOW, THEREFORE, BE TT RESOLVED, that under separate ordinance, the Council of
the City of Saint Paul will prohibit, on any parcel of land or part thereof within the areas of the
Study Area depicted on Exhibit A, the issuance or approval of zoning and building permits, plat
approvals or lot spiits, until the expiration of twelve months as provided in Minn. Stat. §
462.355, Subd.(4), or until such eazlier time as the Council has taken acrion on the
recommendations contained in the study; AND,

BE TT FLJRTHER RFSOLVED, that pending the adoption of the interim ordinance
prohibiting any development inconsistent with the pending study and any amendments to the
City's zoning code within the Study Area boundaries described in Exhibit A, no zoning or
building permits, plat approvais or lot splits may be issued or approved, unless exempted as
provided under the terms set forth in that same separate ordinance noted above, from this date
and until the expiration of twelve months as allowed by Minn. Stat. § 462355, Subd.(4), or until
such earlier time as the Council of the City of Saint Paul has taken acrion on the
recommendarions contained in the study; AND
BE TT FLTRT`HER RESOLVED, that the following aze exempted from the provisions of
this resolurion:
1. Building, plumbing, mechanical and electrical permits for repairs or minor
alterations to conforming or non-confornung structures, or for work necessary to
maintain the health and safety of occupants of such structures.
2. Building, plumbing, mechanical and electrical pernuts for work on dangerous or
vacant buildings administered under Legislative Code Chapter 43.
3. Demolition pernuts for nuisance buildings pursuant to Legislative Code Chapter
45.
4. Building, plumbing, mechanical and electrical permits for structures accessory to
permitted residential uses.

5. Permits for "redevelopment projects," as that term is defined under Minn. Stat. §
469.002, Subd. 14, necessary to complete a"redevelopment plan," as that term is
defined under Minn. Stat. § 469.002, Subd. 16.

2 AND, BE TT FINAI.LY RESOLVED, until such time as the said study has been
3 completed and the Council has reviewed recommendations for possible adoption, city
4 departments receiving written applications for the approvals noted above shall accept the
5 appiications and immediately process them in accordance with the provisions of Minn. Stat. §
6 15.99, Subd. 2 and consistent with the intent of this resolution and the interim ordinance.
