Vavoulis, Mayor � and Members of the City Council Gentlemen: The following is a combined report of the Building Department, Health Department and the Fire Prevention Bureau on conditions of property located at 307 No. Dale Street, owned by Mr. Lawrence A. Applebaum, 512 St. Peter Street. The legal description of the property is,—�-'�� -�°•��-'� ' �'^ ����- ~� Lots 2 and 3, Block 1, SwiftEs Subdivision of Lots 10 and 11, Smith and Lotts Outlots. Inspections were made February 25, 1966. The building was built under a permit issued in 1906, which indicated the use was to be as a dwelling. Dimensions were 50 feet long by 38 feet wide, two stories in height, of wood frame construction. - � EXTERIOR: , The building is presently vacant and open. Doors are unlocked and many of the windows broken. The - exterior porches of the building are in poor condi- tion; the porch column bases are rotting and columns are out of plumb; some of the columns have been parti�ally damaged, the porch floors are broken and rotted, the railings are loose or missing; cornices on the porches and the main part of the building are badly rotted, the rear entrance steps and platforms have been severely damaged. BASEMENT: � Large areas of plaster are loose and falling in the basement stairwel�; plaster is falling, windows are broken and plumbing fixtures have been broken in the laundry room. The boiler room is not separated from the rest of the basement with materials meeting ��� T k . (Hon. Mayor George J. Vavoulis and Members of City Council) .(April 21, 1966) -2- Code requirements and there is no protection to the open wood joist ceilings. Many of the plumb- . ing pipes have been broken or removed. There is a large accumulation of combustible trash, in- cluding old furniture, mattresses, paint, wood and paper littered throughout the basement. • FIRST FLOORt Apt. 1 consists of one room. Plaster is cracked and falling from the walls and ceiling, two windows are broken. In Apt. 2 plaster is cracked and falling from the walls and ceiling, radiators and the sink have been removed. Apt. 3, consisting of one room, has plaster falling from the ceiling, radiators have been removed, bricks are falling down the chimney into the fire- place and one window is broken. � Apt. 4 consists of three rooms, windows are all broken, plaster is falling from the ceiling, the interior trim is smashed, radiators and sink have been removed. All the bathroom fixtures on this floor have been smashed, hall radiators removed, plaster is cracked and falling from the hallway areas and the rooms are littered with accumulation of old furniture and combustible trash� SECOND FLOOR: , Apt. 5 - the sink is missing, window glass is broken, plaster is cracked and loose, light fixtures are broken. Apt. 6 cr�nsists of two rooms. Plaster is falling, floors are sagging, radiators and sink have been removed. Apt. 7� consists of one room, Plaster is badly cracked, the windows are out, radiators and sink have been removed. , Apt. 8 consists of one room, has plaster falling, radiators and sink have been removed and the windows are broken. ' SECOND FLOOR (Continued) : - �pt. 10 consists of one room, the window glass is broken, the door is broken and the plaster is in poor condition. � The plaster in the bathroom of this floor is falling badly, the ceramic floor is also cracked. The bathroom fixtures are either broken or missing, the hall plaster is in poor condition. This floor is also littered with old furniture and combustible trash. On the third floor there are three apartments. This entire third floor area is in very poor condition, with the plaster falling, holes in the walls, plumbing and light fixtures are broken, radia- tors are missing and the windows are broken. • The bath on the third floor is in poor condition, with the floors � rotted, windows- are out and the fixtures are missing. There is , also an accumulation of old furniture and combustible trash strewn about, It is the conclusion of the Bureau of Public Buildings that by ' reason of inadequate maintenance, dilapidation, physical damage, unsanitary condition and abandonment that this building constitutes a hazard to public health, safety and welfare. It is the further ' recommendation of the City Architect that the Council hold a public hearing at ten o�clock A.M. on Friday, �pril 29, 1966 to consider the advisability and necessity of ordering the correction or wreck- ing and removal of the structure on the subaect property, and that the City �rchitect, on behalf of the City Council, notify b.y mail the record owner of the property in question at the last known • _ address, as well as other interested persons of record, of the date and time of this hearing. r rul y u . City Architect � RL�:gg ccs Fire Prevention Bureau = -�- �_� . � ����z . � Y April 28, I966 To: The Mayor and Council of the City of Saint Paul Re: Hearing on 307 North Dale Street Gentlemen: , Based on statements made by Mayor Vavoulis which have appeared in the news- paper and on other information which I ha.ve received, I firmly believe that the � forthcomi.ng hearing is merely a formality to confirm the judgment already rendered to require me to tear down my building at 307 North Dale Street. However, before you rubber-stamp this judgment, I would like you to consider the followi_ng: 1. In. order to obtain nearly two square blocks of land on which to erect apartment rental units and for other purposes, Redeemer Lutheran Church hired its own competent appraiser to . appraise the properties the church wished to acquire. Many of the parcels were subsequently purchased by the church at prices equal to or in excess of the appraised figures. My property was appraised at approximately $33,000.00 by the church appraiser, and I was told by representatives of the church tha.t it was their wish and intention to buy my property. I was at all times and remain willing to sell this prop- erty to Redeemer Arms, Redeemer Lutheran Church or a.n.yone else. ' Reverend Langhans, however, asked me to donate my property to his church on the grounds that I would then get my name in the paper and also because he is part Jewish. These reasons are asinine. Since I have refused to donate my property and have acted in a similar manner as the other owners in the area, Reverend Langhans ha.s made libelous and slanderous statements a.bout me personally and about my builcling to botli the press a.nd to you. He complain.ed to the Building and Health Department offi.cials until, under threat of prosecution, I was forced to vacate the building and all the tena.nts in it from whom I received a signed voluntary petition stating that they liked the place, liked me and did not want to move out. 2. I offered to sell the property to Redeemer Arms for $I7,000.00 which is about one-half of their own appraised figure. Reverend La.nghans agreed to pay this figure if he could get the money reLeased from the Federal Government. He wrote to Washington but was unable to get the money because he had spent too much in acquiring the other property in the area. � -� .`'•_-• . . -2- 3. The St. Paul Housing Authority has said they will take the property and, as I understand it, they have already committed it to Redeemer Arms. In any event, they have asked me not to improve the building as this would raise the cost of their taking it. Redeemer Arms has a�ked me the same thing for the past few years. 4. I now have an offer to sell the property for the purpose of putting up a small grocery store; provided, the land is rezoned from "C" Residence to Commercial. If Redeemer Arm.s really wants this building down they will join in a petition to rezone my land so that I can do something constructive with it and pay the back taxes. My point is that for several years I ha.ve been in a dilemma caused by Reverend Langhans a.n.d have sincerely tried to dispose of or improve this property. Until this winter, I thought and was led to believe that Redeemer Arms would buy my land; subsequently, it was to be taken by the Housing Authority a.nd I expected that it would be taken by now. There has been no i.ncome for nearly a year a.nd now, if my judgment is correct, you want me to incur further expense in tearing • down this buildi.ng. The party making the biggest complaint is responsible for the present situation and, quite frankly, I have no alternative but to resist any order you give here and to try every proper means to protect myself and property. In view of the a.bove and based on what I believe is a just plea, I ask that you lay this matter over until I ca.n get the corner rezoned and sold or until the Housing Authority takes it.
