The vehicle is, and shall remain, the properry of Hinckley Chevrolet. 2. The vehicle wiil not be utilized illegally, improperly, or for hire as a public conveyance. Only drivers employed by the Local govenunent or state and authorized by the Local govemment or state to operate vehicles for and on behalf of the Locai government or state will drive the vehicle. 4. The Local government or state shall not modify, disconnect, or otherwise interfere with the operation of the odometer, emission control equipment, safety equipment, or any other equipment on the vehicle. o�-�3a- 5. All drivers will comply with reasonable driver conduct requirements for a vehicle of this type. 6. The L,oca1 government or State shall be responsible for all fines, forfeitures and penalties incurred by reason of the use of the vehicle. 7. Hinckley Chevrolet makes no warrauties, express or implied or apparent, with regard to the vehicle or its use, and it makes no warranry of inerchantability and no warranty that the vehicle is fit for any particular purpose. 8. Ordinary expenses, such as fuel, aze the responsibility of the local government or State. 9. At the end of the term of this evaluation, or earlier if requested by Hinckley Chevrolet, the Local government or State wiil return the vehicle to Hinckiey Chevrolet in the sasne condition as it was when it was provided. The Local government or State will be responsible for any damage to the vehicle incurred while in its possession. The Local government or State will report any accident, vehicle damage or theft to Hinckley Chevrolet immediately. 10. The Loca1 government or State maintains automobile liability and comprehensive property damage insurance that complies with the minimum coverages necessary under Minnesota law, and the insurance extends to the use of the vehicle for a tast drive. 11. The Loca1 government or State agrees to defend, indemnify and hold hannless Hinckley Chevrolet and its respecrive officers, directors, shazeholders, affiliates, agents, employees and representatives from and against any claims, demands, causes of action, expense, loss or liability of any kind (including reasonable attorney's fees) arising out of the use, possession, custody or control of the vehicle. 12. The undersigned is authorized to sign this agreement on behalf of the Local govenunent or State listed above, and by its signature accepts all terms and conditions of this agreement.
