RESOLVED, upon the 'pertinent appeal under the Zoning
Code by Frances M. Merchant� as owner of the subject property
situate in the City of Saint Paul, described as Lots 3 and
4, Block 20� Lyman Daytons Addition to the City of Saint Paul,
located on the north side of Fifth Street between Bates Avenue
and Maple Street, that the provisions of said Zoning Code
hereby are determined and varied in application so that the
. premises may contain separate accommodations for several� not
in excess of four families, provided that the continuance of
such four-family �we��ling be for the remaining life of the
structure now on said premises, and provided further� that the
appellant comply with the changes set forth in the Bureau of
Public B uildings and Housing Code Division report dated
March 7 � 1966, and provided further, that such permission shall
lapse ipso facto unless the appellant is in full' compliance with
the above report� dated March 7, 1g66, within one year from
the date of this resolution� and provided further, that the
appellant provide a total of four off-street parking spaces for said
dwelling, acceptance of this resolution and terms to be made
by the appellant, and subject to compliance with said provi-
sions� the Council expressly finds that such relief will bs
consistent with the p ublic health and general welfare, and that
said relibef and permission herein granted is subject to the
further condition that the appellant and her successors and
assigns otherwise shall make due compliance with all applicable
provisions of Municipal Ordinances, State Statutes, rules and
regulations of public authorities having cognizance; further,
. that a copy of this Resolution be filed with the Register of
Deeds in and for Ramsey County, Minnesota.

Dear Sir: �
This is written in response to the Appeal of Frances M. Merchant �
to legalize and continue an existing illegal four-family use on '
property classified as "B" Residence. The property is located on
the north side of Fifth Street between Bates Anenue and Maple
Street, described as Lots 3 and 4, Block 20, Lyman Dayton's Addi-
� tion.
In 1885 the present structure was constructed with a ground area
� ,�as delineated•by its foundation of 1,740 square feet. At some
later date the structure was extended without authorization to a
, - four-plex. Since the property is classified as "B" Residence
which would restrict it to a two-family use, the applicant must ,
secure Council authorization under Chapter 64.03, Section o,
' par 2 of the Legislative Zoning Code to continue the four-family
use. • � '
The Board of Zoning heard this request on March 17, 1966. It was
the Board's findings that it would be reasonable to permit the _
four-family use to continue for the remaining life of the struc-
. ture provided that the applicant comply with the changes as set�
� _ forth in the Bureau of Public Buildings � Housing Code Division
report dated March 7, 1966, a copy of which is attached, and
` further provided that four off-street parking spaces are developed
on the property. It is also the Board of Zoning's recommendation
, that should the Council grant the Appeal, a copy of the resolution
be filed with ttie`deed to. said property in the office of the

removal to meet the minimum requirements of the Housing Code and

l . Install a hand lavatory in the bathroom of Unit #1
at 737 E. Fifth Street. .
2. Install handrails in the -basement stairways at both
735 and 737 E. Fifth Street.
3. Remove the extension cords used to provide additional •
outlets throughout the building.
4. Provide additional light to the stairway at 737 E.
Fifth Street. �
5. Provide an additional outlet in the dining room and
front bedroom of the first floor apartment at 737 E.
Fifth. �
6. Remove the BX wiring system as used in the basement and
replace it with a system that meets Code requirements.
7. Repair the faulty fixture in the basement at 735 E. Fifth.
8. Remove the hazardous wiring in the back entry of 735
E. Fifth on the second floor. _
