WHEREAS, John W. Bird, an employee of the Department of Public
Works , was injured in a third party accident on May 14, 1962 , while
engaged in the performance of his duties ;;�and
WHEREAS, the City has incurred medical expense in the amo�nt of
$385.55 therefor, and said employee was disabled from work for a
period of time, being paid compensation in the amount of $36.00 ; and
WHEREAS, a settlement has been negotiated between said employee, �
through his attorney, Michael G. Simon, and the other party involved
in said accident, in the total amount of $3,000.00 , out of which the
City tail]. receive $210.78, less one fourth attorney's fees; now,
therefore, be it
RESOLVED, That the proper City Officers are hereby authorized
to accept in fu11, final, and complete settlement of its claim herein
the sum of $158.08 and to execute any necessary releases therefor and
to �issue a cfieck in the amount of $52.70 to employee's attorney,
Michael G. Simon, as and for attorney's -fees in this matter, and that
said amount received in settlement be credited to the Workmen's
Compensation Fund; ,
