228035 �rlainal to City Clerlc � _ . � � � � �ORDINANCE �����`� COUNCIL FILE NO. � PRESENTED BY Milton -^ ORDINANCE NO. �•c � An ordinance authorizing The Gillette Company, a corporation, to construct , and maintain a 10" fire protection water main in Prince St. and in Broadway in connection with the construction of the-shipping center for the Toni Company. This is an emergency ordinance rendered necessary for the preservation of the � . public peace� health and safety. The Council of the City of Saint Faul Does Ordain: SECTION 1 That upon compliance with the conditions hereinafter set out, the Commissioner of Public Works is authorized to issue a permit to �'he Gillette Company, a corporation, to construct a 10" fire protection water main 5'6" south of the north line of Prince St. from Broadway to 236� east and 4� west of the east line of Broadway f rom Prince St. to 44� north. The conditions are as follows: � . - 1. Fermittee shall furnish a bond of $5,000 to the City of Saint Paul, � conditioned to save said City harmless from any and all liability, judgments� , - suits, costs, damages or expense accruing to person or property, arising out - of the construction, maintenance, use, presence or removal of said water main. Said bond shall be satisfactory to the Commissioner of Finance as to surety, to the Corporation Counsel as to f orm and execution, and shall be filed with the City Comptroller. 2. Fermittee shall file plans and specifications for said water main with - the Commissioner of Public Works, which shall be satisfactory to the Chief Engineer, and said water main shall be constructed as said Engineer shall direct. Permittee shall pay the cost of inspection, if any. _ , 3. This permit may be revoked by the Council at any time, and thereupon .., permittee shall remove said water main, � 4. Fermittee shall pay the cost of the publication of this ordinance. \ 5. Permittee shall, within ten days after the publication of this ordinance, 1 file a written acceptance thereof with the City Clerk. ' SECTION 2 This ordinance is hereby declared to be an emergency ordinance� rendered necessary for the preservation of the public peace, health and saf ety. SEGTION 3 Permittee shall pay to the City any cost incurred� by reason of the granting of this permit. ' = SELTION 4 � .
