1 WIIEREAS, Neighborhood Housing and Properry Improvement (NfIPn has requested the City
2 Council to hold public hearings to consider the advisability of revoking the rental registration certificate
3 for a duplex rental property located at 721 PLUM ST and registered to Nick Johnson; and

WHEREAS, on Februaiy 17, 2005, NHPI conducted an inspection of said property and issued a
Correction Notice with a compliance deadline of February 24, 2005; and
WIIEREAS, on February 24, 2005, NHPI conducted a reinspection of said property and found

lack of compliance with the previous order; and
WHEREAS, on February 28, 2005, NHPI sent the holder of the rental registration certificate for
the subject properry, Nick Johnson, a$50 excessive consumption bill, addressed to 501 Dale St N Suite
202, St Paul MN 55103-1914, the address on said certificate; and
WHEREAS, as of April 19, 2005, said $50.00 has not been paid, and Legislative Code §51.06 (a)
(v) provides that non-payment of fees for excessive consumption is grounds for certificate revocation;
and
WHEREAS, on February 28, 2005, NHPI notified Nick 7ohnson of the need to arrange an
interior inspection of the subject property; and
WIIEREAS, as of April 19, 2005, an interior inspection has not been arranged, and Legislative
Code §51.07 (a) (iii) provides that the imposition of an excessive consumption fee is grounds for an
interior inspection; and
WHEREAS, on April 5, 2005, NHPI sent Nick Johnson the proper Notice of Intent to Revoke
Rental Registration (copy attached); and
WHEREAS, Nick Johnson has not appealed said notice and the fime for filing an appeal has
expired; now therefare
BE IT RESOLVED, that based on the faregoing, the Saint Paul City Council hereby adopts the
following findings and order concerning the subject property at 721 PLUM ST .
That the subject property is a duplex rental properiy that is required to be registered with
the City's Rental Registration Program.

2. That the holder of the Rental Registrarion Certificate for the subject property is Nick
Johnson.
That said certificate hoider has been biiled for excessive consumption of code inspection
services, which has not been paid.

That said certificate holder has been requested to allow an interior inspection of the
subject properiy, which has not been arranged.

That the notification requirements of Chapter 51 have been fulfilled and the time for an
appeal has expired without an appeal being made.

The Saint Paul City Council hereby makes the following order:
The above-referenced Rental Registration Certificate issued to Nick 3ohnson for the
duplex rental property at 721 PLUM ST , Saint Paul, MN is hereby revoked.

It is further ordered that a copy of this resolution be mailed to Nick Johnson.

I am writing to you in your capacity as the holder of a rental registration certificate for 721 PLUM ST, St. Paul

You are hereby notified, pursuant to the authority granted to me under Chapter 51 of the St. Paul Legislative
Code, of the City's intent to revoke the registration certificate for 721 PLLJM ST based on the following:
On February 17, 2005, this department conducted an inspection of said property and issued a
Correction Notice with a compliance deadline of February 2G, 2005.

On February 24, 2005, this department conducted a reinspection of said property and found lack
of compliance with the previous order.
On February 28, 2005, this deparhnent sent you a$50.00 bill for the cost of said reinspection.
As of today this $50.00 has not been paid.
On February 28, 2005, this department notified you by mail of the need to arrange an interior
inspection of said rental property.
As of today this interior inspection has not been arranged.
I have referred this matter to the St. Paul City Council with a recommendation to revoke the rental registration
certificate. The City Council will revoke unless an appeal is filed in the next thirteen (13) days from the date of
this notice. An appeal may be filed pursuant to legislative Code § 18.02, by appearing in person between the
hours of 8:00 a.m. and 430 p.m. on any business day at the City Cierk's O�ce, Room 170, City Hall, IS W.
Kellogg $oulevazd, St. Paul, MN or you may appeal by mail within the same 13 day rime line.
Once the City Council has revoked the rental registration certificate, occupancy of the properiy is not allowed

withdrawn from consideration by the City Council.
