WI�EREAS, Neighborhood Housing and Property Improvement (N�IPn has requested the City
Council to hold public hearings to consider the advisability of revoking the rental registrafion certificate
for a duplex rental property located at 724 STH ST E and registered to Rosebear, Inc; and
WHEREAS, on May 11, 2004, NHPI conducted an inspection of said property and issued a
Conection Notice with a compliance deadline of May 27, 2004; and .
WHEREAS, on May 27, 2004, NHPI conducted a reinspection of said property and found lack of

compliance with the previous order and granted an extension; and
WHEREAS, on June 16, June 29, August 13, August 24, September 23, October 12, October 26,
2004, NHPI conducted reinspections of said property and found lack of compliance with the previous
order;and
WHBREAS, on June 17, June 30, August 16, August 26, SepYember 24, October 13, October 28,
2004, NHPI sent the holder of the rental registration certificate for the subject property, Rosebear, Inc,
excessive consumption bills, addressed to Po Box 130722, Roseville MN 55113, the address on said
certificate; and
WHEREAS, as of January 6, 2005, $700.00 in excessive consumption bills haue not been paid,
and Legislative Code §51.06 (a) (v) provides that non-payment of fees for excessive consumption is
grounds for certificate revocation; and
WFlEREAS, on June 17, 2004, NHPI notified Rosebear, Inc of the need to an an interior
inspection of the subject property; and

27 WHEREAS, as of January 6, 2005, an interior inspection has not been arranged, and Legislative
28 Code §51.07 (a} (iii) provides that the imposition of an excessive consumption fee is grounds far an
29 interior inspection; and

31 WI�EREAS, as of January 6, 2005 code violations remain uncorrected and Legislative Code
32 §51.06(a)vii provides that non-compiiance with the code is �ounds for certificate revocarion; and

34 WHEREAS, on December 17, 2004, NHPI sent Rosebear, Inc the proper Notice of Intent to
35 Revoke Rental Registration (copy attached); and
36
37 WFIEREAS, Rosebear, Inc has not appealed said norice and the fime fox filiiig an appeal has
38 expired; now therefore

� BE IT RESOLVBD, that based on the foregoing, the Saint Paul City Council hereby adopts the
following findings and order cottcerning the subject ptoperty at 724 STH ST B.
That the subject proper[y is a dupiex rental properiy that is required to be registered with
the City's Rental Regisiration Program.

That the holder of the Rental Registration Certificate for the subject properiy is Rosebeaz,
Inc.
2.
That said certificate holder has been billed for excessive consumpfion of code inspection
services, which has not been paid.
3.
That said certificate holder has been requested to allow an interior inspection of the
subject properiy, which has not been arranged.

That the notification requirements of Chapter 51 have been fulfiiled and the time for an
appeal has expired without an appeal being made.

The Saint Paul City Council hereby makes the following order:
The above-referenced Rental Registration Certificate issued to Rosebear, Inc far the
duplex rental property at 724 STH ST E, Saint Paul, MN is hereby revoked.

It is further ordered that a copy of this resolution be mailed to Rosebear, Inc.

I am writing to you in your capacity as the holder of a rental registration certificate for 724 STH ST E, St. Paul
MN.
You are hereby notified, pursuant to the authority granted to me under Chapter 51 of the St. Paul Legislative
Code, of the City's intent to revoke the registration certificate for 724 STH ST E based on the following:
On May 11, 2Q04, this department conducted an inspection of said property and issued a
Correction Notice with a compliance deadline of May 27, 20Q4.

On May 27, 2004, this depariment conducted a reinspection of said properiy and found lack of
compliance with the previous order and granted an extension.
On June 16, 2004 this department conducted a reinspection of said property and found lack of
compliance with the previous order.
On June 17, 2004, this department sent you a$50.00 bill for the cost of said reinspection.
As of today this $50.00 has not been paid.
On June 17, 2004, this department notified you by mail of the need to arrange an interior
inspection of said rental properiy.
As of today this interior inspection has not been arranged.

compliance with the previous order.

of compliance with the previous order.

interior inspection of said rental properry.
25. On October 12, 2004, this deparhnent conducted an inspection of said property and found lack of
compliance with the previous order.
26. On October 13, 2004, this department sent you a$I50.00 bill for cost of said reinspecrion.
27. As of today this $150.00 has not been paid.

interior inspection of said rental properry.
29. On October 26, 2004, this depariment conducted an inspection of said properry and found lack of
compiiance with the previous order.

32. On October 28, 2004, this department again notified you by mail of the need to anange an
interior inspection of said rental property.
33. As of today this interior inspection had not been arranged.
34. As of today there aze still outstanding code violations that have not been conected.
T have referred this matter to the St. Paul City Council wiCh a xecommendation to revoke the rental registration
certificate. The City Council will revoke unless an appeal is filed in the next thirteen (13) days from the date of
this notice. An appeal may be filed pursuant to legislative Code § 18.02, by appearing in person between the
hours of 8:00 am. and 430 p.m. on any business day at the City Clerk's Office, Room 170, City Hall, 15 W.
Kellogg Boulevard, St. Paul, MN or you may appeal by mail within the same 13 day time line.
Once the City Council has revoked the rental registrafion certificate, occupancy of the property is not allowed
until (1) an inspection by Neighborhood Housing and Property Improvement (NHPI) has been conducted, (2)
the Director of NHPI has determined the properiy to be in compliance, and (3) the certificate is renewed. Note:
Renting a properiy without a certificate is a misdemeanor.
Please call me as soon as possible to arrange a meeting to discuss how to correct this situation before the Cit��
Council acts to revoke this certificate. If all issues are addressed, I will recommend that the revocation be
withdrawn from consideratlon by the City Council.
