Marshall City Clerk Room 386 City Hall & Court House Dear Sir: This is written in response to the petition of Gerald Frisch to rezone from "A" Residence to "C" Residence property located at the southwest corner of Albemarle Street and Larpenteur Avenue and described as Lots 1 through 5, Block 2, Rice Street Villas. The applicant proposes to utilize this property, along with adjoining property to the west and south (for which he is also petitioning for rezoning), to assemble a land package for a 79 unit apartment building f acing Larpenteur Avenue. This matter, as well as the petitions for rezoning of the adjacent two properties, were considered at the November 2, 1967 Board of Zoning Meeting. The staff reported that the Commissioner of Finance had reported the petition valid with 26 of a possible 30 (86 2/3%) owners of tracts within 100 feet signing. The entire block is presently zoned "A" Residence. East of the block is zoned commercial and south and west are zoned "A" Residence. Present development of the area includes apartments to the north, a shopping center to the east, and vacant property beyond which is single-family development to the south and west. The Comprehensive Plan recommends R-2 single-family homes for this area. The staff re- ported that a number of sites in the general area have in recent years been rezoned to allow multi-family dwellings, but that much of the re- zoned area has not as yet been developed. It was the findings of the Board that if development of the total property was oriented to Larpenteur Avenue and parking were limited _to land ad�acent to Albermarle Street, the development would not have a detrimental effect on the area. Mr. Frisch made the following statement as quoted from the November 2, 1967 Board of Zoning Meeting, "In reply, Mr. Frisch said he has a petition to be submitted vacating the alley up to Lots 24-27. He would dedicate property to provide an "L" alley for the use of single- faatily dwellings in the block. He said they would bring in new plans showing the apartment building £acing on Larpenteur Avenue, with all the parking on Albermarle Street across from the commercially zoned and developed property." � �° - ��. � ' . , � Mr. Harry E.
