' CO�JRICIL RESOLUTION—GENERAL FORM PRESENTED BY / COMMISSIONE DATE In the Matter of a hazardous building being that two story two family frame dwelling known and � described as 585 Dayton Avenue in the City of Saint Paul and situated upon those premises legally des- cribed as the East one-half of Lot 18, Block 2, Woodland Park addition to the City of St. Paul, according to the plat on �ile and of record in the office of the Register of Deeds in and for the County of Ramsey, State of Minnesota. W�REAS, Pursuant to resolution, C. F. 235662, approved November 7, 1967, a public hearing was duly held on Tuesday, November 21, 1967, before the Council of the City of Saint Paul, said hearing pertaining to the condition of the structure located at 585 Dayton Avenue, Saint Paul, Minnesota; and . WHEREAS, Upon the facts presented at the said hearing consisting of photographs, inspection reports and the recommenda- tion of the City Architect, it is found and determined by the City Council that according to the records and files in the office of the Register of Deeds, the last record own.er of the above-described property is Mary K. Wohl; that Saint Paul Federal Savings and Loan Association is the mortgagee; and that there are no other lien holders of record; and that it is further determined that the above-described building constitutes a hazardous . building within the .definition of Minnesota Statutes Section 463. 15 for the following reasons: , �'ORM PPROVED Ass Corporation oun el � COUNCILMEN . The building is standing vacant, open, vandalized and subject to entry by unauthorized persons; � b. The front porch roof boards and windowsills have rotted, the gutters have rusted through, the rear shed roof is sagging due to failure of one of its supports , the front porch supports are rotted, the roof of the building and the west side wall sags ; c. The basement stairway is dilapidated with treads split and parts missing; the �irst floor joists and supporting beams are rotting, pieces of the kitchen flooring are loose, sections of the gypsum board are torn off the ceiling, large cracks in the plaster walls, the floors sag, and the stairway between the first and second floors is dangerous and its treads are loose; d. The building is beyond reasonable -- repair; • � e. The building is unfit for human habitation in its present condition and the above corrections must be made in compliance with the Building Code and the Housing Code of the City of Saint Paul in order to make the same habitable; f. I � . . � ; �C.7'',:'��.� � Page 3. , RESOLVED, That in accordance with Min.nesota Statutes Sections 463. 15 through 463. 26, and based upon the foregoing findings of the City Council, the Council of the City of Saint Paul does hereby make the following Order: ORDER 1. The owner of the above-described building shall make the same safe and not detrimental to the public health, safety and welfare by having the said building razed and the materials therefrom removed from the premises within thirty (30) days from the date of the service of this Order, or, in the alterna- tive, begin to correct the hazardous conditions within thirty (30) days �rom the date of the service of this Order by doing the following: � a. Remove all paper and other combustible materials from the building and securely close and keep closed all doors, windows or other ' openings in the building; b. If the building is to be .used for _ human habitation, all of the above' defective • conditions must be corrected and the building corrected so as to comply with and meet the Saint Paul Housing Code and the Saint ,Pau� . Building Code requirements , and that the owner submit a list of mtended corrections regarding the structural condition of the building, electrical and heating system, together with a schedule for the completion . of the rehabilitation program and that the own.er apply for the necessary permits in the office of the City Architect within the thirty (30) days imposed herein. � � � � 2. Coun.ty, Minnesota, within twenty (20) days from the date of the service of this Order, a Motion for Summary Enforcement of this � Order to raze and remove the said building will be made to the Ramsey Coun.ty District Court. 3. In the event that the building is to be razed by the City of Saint Paul pursuant to judgment of the District Court, all personal property or fixtures which may unreasonably inter— fere with the razin and removal of this building shall be removed within ten �10) days from the entry of judgment; and if not so removed, the City of Saint Paul shall remove and dispose of such personal property and figtures as provided by law. 4.
