WHEREAS, Pursuant to resolution, C. F. 235663, approved
November 7, 1g67, a public hearing was duly held on Tuesday,
November 21, 1967,- before the Council of the City of Saint Paul,
said� hearing pertaining, to the condition of the structure located
at 765 Pierce Butler Routea, and ,
WHEREAS, Upon_the , facts presented at the saidF hearing �•-" i
consisting of photographs, inspection reports and the recommenda— ��' _ I
tion of the City Axchitect, it is foun.d and determined by the
City Council that according to the recorda and files in the
o.�fice of the Register of Deeds, the last record owners of the
above—described property are John Joseph Sheridan and Margaret
Sheridan; that according to the records of the County Treasurer,
Juan Garay is the contract• purchaser of the subject property, and
ta� notices are being sent to C. G. Rein Co. ; and that there are
no other lien holders of record; and that it is further determined
that the above—described building constitutes a hazardo s building
within the definition of Minnesota Stat es Sectio 46 15 for

persons; -
b. The wall plaster' is badly cracked
and in danger of fa.11ing, the floors sag due
to failure of the foundation and supporting
„ joists, a section of the kitchen ceiling has
fallen and is supported by a smoke pipe
serving a water heater, the interior stair-
_ way is in an unsafe condition and is weak,
the plumbing fixtures have been. removed and
damaged,, the electrical system has been . .

is beyond reasonable repair;

e. The building constitutes a nuisance t � ��
and a hazard to the public �health, safety and ��i
welfare because of its physical damage, '=: ,
dilapidation, inadequate maintenance and �
abandonment; �
now, therefore, be it
�" RESOLVED, That in accordance with Minnesota Statutes Sections
463. 15 through 463. 26, and based upon the foregoing findings of
the City Council , the Council of the City of Saint Paul does hereby
make the following Order:

ORDER '
l. The own.ers of the above-described building shall make
the same safe and not detrimental to the public health, safety
and welfare by having the said building razed and the materials
therefrom removed from the premises within thirty (30) days from �
the date of the service of this Order or, in the alternative,
begin to correct the hazardous conditions within thirty (30) _ ��.
days from the date of the service of this Order by doing the _ �'
following: . �
a. -� Remove all paper and other combustible
materials from the -building� and securely close
and keep closed all 'doors , windows or �other
openings in the building;

� b. If the building is to be used for human
habitation, all of the above defective conditions
�� must be corrected and the �building corrected so
_ as to comply with and meet the Saint Paul Housing
CodE and the Saint Paul Building Code require- �
merits, and that the owners submit a list of
intended corrections regarding the structural
ebndition of the building, electrical and � •
� heating system, together with a schedule for
the completion of the rehabilitation program �-
and that the own.ers apply for the necessary ,
permits in the office of the City Architect
within the thirty (30) days imposed herein. .-

2. Unless such corrective action is taken to comply with
this Order or an. answer served upon the City of Saint Paul and
�`r filed in the Office of the Clerk of the District Court of Ramsey
. County, Minnesota, within twenty (20) days from the date of the
aervice of this Order, a Motion for Summary Enforcement of this
Order to raze and remove the said building will be made to the
Ramsey County District Court.

- 3. In the event that the building is to be razed by
the City of Saint Paul pursuant to judgment of the District
Court, all personal property or fixtures which may unre�asonably
interfere with the razing and reinoval of this building shall
be removed within ten (10) days from the entry of judgment; and
if not so removed, the City of Saint Paul shall remove an.d
dispose of such personal property and fixtures as provided
by law.
4. If the City of Saint Paul is compelled to take any
corrective action herein, all necessary costs expended by the
City will be assesaed against the above–described real estate
and collected as other taxes; and be it
FURTHER., RESOLVED, That a certified copy of this resolu–
tion and incorporated Order herein be served upon the last
record owner of the above–described property in. the man.n.er
provided by law and also upon other interested parties in the
manner provided by law. _
