WHEREAS, MSP Metro Development Co., LLC, 04-214-428 has submitted for City Council approval the
attached Combined Piat for subdivision of property at 980 and 1006 Rice Street to create 2 commercial parcels;
and
WHEREAS, the appropriate City departments have reviewed the plat and found, subject to the recommended
conditions, that it meets the requirements of Chapter 69 of the Zoning Code; and
WHEREAS, notice of a public hearing before the City Council was duly published in the official newspaper of the
City and notices were mailed to each owner of affected property including all property situated within 350 feet of
the subject property; and
WHEREAS, the City Council held a public hearing on April 6, 2005 on the proposed plat where all interested
parties were given the opportunity to be heard and the Council considered all the facts and recommendations
concerning the plat;
NOW, THEREFORE, BE IT RESOLVED, that the City Council accepts and approves the attached preliminary
and final plat for MSP Metro Development Co., LLC at the 998 Rice St subject to the following condition:
The applicant shall file a copy of the Council Resolution approving the plat with the Ramsey County
Recorder's Office.

E. ZONING CODE CITATIOIV: §69.301 states that platting is required when a subdivision: (1)
creates five or more lots or parcefs, each of which is 2Y2 acres or less in size; or (2) requires
paved streets, alieys and other public improvements; or (3) is previously unplatted land. §69.304
lists conditions for lot splits and adjustments of common boundaries. §69.406 provides criteria
for review of subdivision appiications. These criteria are covered below under "Required
Findings."
F. HISTORY/DISCUSSION: None found
G. DISTRICT COUNCIL RECOMMENDATION: District 6 supports the plat, provided the requisite
landscaping, pedestrian lighting and wrought iron fence surrounding the site are provided.
H. REQUIRED FINDINGS: § 69.406 of the Zoning Code requires that all of the following findings
shall be made prior to approval of a subdivision:
1. All the applicabte provisions of the Legislative Code are complied with. This condition has
been met. City staff has reviewed the proposed plat and have determined that all app,�cab!e
provisions of city codes are met.
2. The proposed subdivision will not de detrimental to the present and potential surrounding
land uses. This condition is met. The proposed plat is consistent with the surrounding land
uses, and will not be detrimentai to present or future use of surrounding land.
3. The area sur�ounding the subdivision can be planned and developed in coordination and
compatibility with the proposed subdivision. This condition is met. The area surrounding the
proposed plat is already developed and compatible with the proposed plat.

4. The subdivision is in conformance wifh the comprehensive plan. The subdivision is in
conformance with the Land Use chapter of the comprehensive plan, which calls out this area
as Pedestrian Neighborhood Commercial Centers (p28). Objective 5.2.1 calls for mixed use
wiffiin single buildings and in separate 6ui(dings in close proximity. Further, the deveiopmenf
is along a major bus route, improving access to all potential patrons.
5. The subdivision preserves and incorporates fhe site's important existing natural features
whenever possib/e. The site is in a fuliy-developed part of St. Paul with no remaining natural
features.
6. All land intended for building sites can be used safely withouf endangering residents by peril
from floods, erosion, continuously high water table, severe soil conditions or other menace.
The site is a flat, fully developed area with no Flooding, erosion, high water table or soil
condition problems. However, the dedication of the 10 foot drainage and utility easement is
not necessary.
7. The subdivision can be economically served with public facilities and services. The
subdivision can 6e economica(ly served with public facilities and services from surrounding
streets.

f. STAFF RECOMMEM1IDATION: Based on required findings 1 through 7, staff recommends
approval of the final plat for MSP Metro Development Co. LLC subject to the condition that:

• In keeping with the Large Area P{an, District 6 hopes that the lot woutd include
landscaping, pedestrian lighting and a wrought iron fence surrounding the lot
If feasible, built in bench pockeu around the sidewaiks could be included.
Beautifying the lot would certainly increase the aesthetics in and around this area, going
a long way in assisting the revamping of Rice Street.
