05-360Council File # O � _ ��� Resolution # Green Sheet # 3026092 RESOLUTION CITY OF SAINT PAUL, MINNESOTA �� RESOLUTION AUTHORIZING APPLICATION TO THE MINNESOTA DEPARTMENT OF EMPLOYMENT AND ECONOMIC DEVELOPMENT, THE METROPOLITAN COUNCIL, AND RAMSEY COUNTY FOR CONTAMINATION INVESTIGATION AND CLEANUP GRANTS FOR THE CARLETON PLACE, TINIBER CRAFT, AND LOEB LAK� SITES Presented By Referred To �v Committee: Date WHEREAS, the City of Saint Paul, Minnesota is a participant in the Livable Communities Act's Housing Incentives Program for 2005 as determined bythe Metropolitan Council, and is therefore eligible to make application for funds under its Tax Base Revitalization Account; and 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 33 34 35 36 37 38 39 40 41 WI3EREAS, the City has identified environmental investigation and clean-up projects within the City that meet the purposes and criteria of the Contamination Cleanup Grant Program of the Minnesota Department of Employment and Economic Development (DEED), the Taz Base Revitalization Account Grant Program of the Metropolitan Council, and the Environmental Response Fund of Ramsey County; and WHEREAS, the City has the legal authority to apply for financial assistance, and the institutional, managerial and financial capability to ensure adequate project administration; and WHEREAS, the City of Saint Paul certifies that it has not violated any Federal, State or local laws pertaining to fraud, bribery, grafr, kickbacks, collusion, conflict of interest or other unlawful or corrupt practice and that it will comply with all applicable laws and regulations as stated in the contract agreements; and WHEREAS, the City of Saint Paul, Minnesota agrees to act as legal sponsor for the proj ects contained in the cleanup grant applications submitted to DEED, the Met Council, and Ramsey County on May 2, 2005; NOW, TFIEREFORE, BE IT RESOLVED that the City Council of the City of Saint Paul, Mimmesota hereby approves the contamination investigation and cleanup grant applications submitted to the Department of Employment and Economic Development, the Metropolitan Council, and Ramsey County on May 2, 2005 by the City of Saint Paul for the Cazleton Place, Timber Craft, and Loeb Lake sites; and BE IT FURTHER RESOLVED that the sources and amounts of the local match identified in the applications are committed to the projects identified; and BE IT FURTHER RESOLVED that upon approval of its application by DEED, the Metropolitan Council, and Ramsey County, the City of Saint Paul may enter into agreements with them for the above-referenced projects, and that the City of Saint Paul certifies that it will comply with all applicable laws and regulation as stated in all contract agreements; and BE IT FURTFIER RESOLVED that the Director of the Department of Planning and Economic Development of the City of Saint Paul is hereby authorized to execute such agreements as are necessary to implement the projects on behalf of the applicant.
