05-359� b�f � ( � y/a7�avoS RESOLUTION CITY OF SAINT PAUL, NIINNESOTA Presented By Referred To CouncIl File # `-�S - 3 s9 Green Sheet # J� �°� �O � 9 p Committee: Date 2 WHEREAS, the City, pursuant to piamring commission resolutions no.'s OS-13 and OS- 3 14, each dated Febrnary 11, 2005, has assembled a task force and initiated a"40 acre study" for 4 the Loeb Lake area in the City's North End as set forth on the map entitled "Loeb Lake Small 5 Area Plan and Zoning Study" (hereinafter, "the Study Area") and attached hereto and 6 incorporated herein by reference as E�ibit A; and 7 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 33 34 35 36 37 38 39 40 WIIEREAS, the City's plauning process far the Study Area will address various redevelopment opportunities and recommend appropriate zoning classifications and development guidelines for the redevelopment and transformation of the Study Area and to incorporate those classifications an@ guidelines into the City's comprehensive plans anc3 o�cial contro2s; and WHEREAS, some existing or former commercial and industrial uses and some present zoning classifications within the Study Area may a11ow development in the neaz term which would be incompatible or inconsistent with any long term goals recommended and adopted by the City based upon the plamiiug process initiated under the said plannnig commission resolufions noted above; and WHEREAS, the potential for incompatible or inconsistent development within the Study Area raises substanfial questions relating to the ability of the City's present official controls to provide compliance with the longer term redevelopment and transformation goals for the Study Area as well as the comprehensive plan; and WHEREAS, because the planning process for the Study Area is incomplete and for the purpose of preserving the stalus quo regarding land use in the study area, and far the purpose of preserving the publids health, welfare and safety pending the conclusion of the said study, the Council of the City of Saint Paul desires to immediately temporarily prohibit development on any parcel of land or part thereof within the Study Area depicted on E�chibit A, until such time as the afarementioned study has been completed and presented to the planning commission and the Council has taken action on any recommendations contained therein: NOW, THEREFORE, BE IT RESOLVED, that under separate ordinance, the Council of the City of Saint Paul will prohibit, on any parcel of land or part thereof within the areas of the Study Area depicted on E�ibit A, the issuance or approval of zoning and building permits, plat approvals or lot splits, until the expiration of twelve months as provided in Minn. Stat. § 462355, Subd.(4), or until such earlier time as the Council has taken action on the recommendations contaiued in the study; AND, os- �s� BE IT FURT'HER RESOLVED, that pending the adoprion of the interim ordivauce prohibiting any development inconsistent with the pending study and any amendments to the City's zoaing code wiYhin the Study Area boundaries described in Exhibit A, no zoning or building permits, plat approvals or lot splits may be issued or appmved, unless exempted as provided under the ternis set forth in tUat same sepazate ordinance noted above, from this date and until the expiration of twelve months as allowed by Minn. Stat. § 462355, Subd.(4), or until such eazfier time as the Council of the City of Saint Paul has faken acfion on the recommendations contained in the study; AND BE IT FURTf�R RESOLVED, that the following aze exempted from the provisions of tlus resolurion: 1. Building, plumbing, mechanical and electrical pernuts for repairs or minor alterations to confornung or non-confomung sriuctures, or for work necessary to mainfain the health and safety of occupants of such structures. 2. Building, plumbing, mechanical and electrical permits for work on dangerous or vacant buildings administered under Legislative Code Chapter 43. 3. Demolition permits for nuisance buildings pursuant to Legislative Code Chapter 45. 4. Permits for "redevelopment proj ects," as that term is defined under Minn. Stat. § 469.002, Subd. 14, necessary to complete a"redevelopment plan " as that term is defined under Minn. Stat. § 469.002, Subd. lb. AND, BE IT FINALLY RESOLVED, until such time as the said studyhas been completed and the Council has reviewed recommendations for possible adoption, city deparlrnents receiving written applications for the approvals noted above shall accept the applicafions and immediately process them in accardance with the provisions of Minn. Stat. § 15.99, Subd. 2 and consistent with the intent of this resolution and the interim ordinance. Stax. § 462. , Subd.(4), or until such eazlier time as the CouncIl of the City of Saint Paul has taken acti on the recommendations contained in the study; AND BE IT FURTHER RESOLVED, until such tune he said study has been completed and the Council has reviewed its recommendations for po le adoption, city departments receiving written applications for the approvals noted above all accept the applications and immediately process them in accordance wifh the provisions Minn. Stat. § 15.99, Subd. 2 and consistent with the intent of the interim ordinance.
