An ordinance amending Chapte� 410 of the
Sai.nt Paul Legislative Code, as amended,
authorizing the playing of Bingo by
certain organizations and providing for
' the licensing and regulation thereof.
THE COUNCIL OF THE CITY OF SAINT PAUL DOESaORDAIN:
_ Section 1. That Chapter 410 of the Saint. Paul Legislative
Code, as amended, is hereby further amended by deleting the
same in its entirety and substituting in place and in lieu
thereof the following:
410.01. Bingo Defined.- As used in this
chapter, the term '�bingo" means the same as in
Minnesota Statutes 349.01 through 349.03.
410.02. License Required. No person except an
association authorized under Minnesota Statutes to
conduct the game of bingo may receive a license or
permit under this chapter. No person shall conduct
the game of bingo without such license or permit.
410.03. Two Year Existence Required. No
permit shall be issued to any organization or
association provided for in Minnesota Statutes
349.01 to 349.03, unless such organization or
association shall have been in existenee in the
City for at least two years prior to the date of
making application for such permit. However, said
time limitation shall not apply to a subsidiary of any
religious, charitable or fraternal organization of
national or statewide jurisdiction that shall have
been in existence in excess of two years.
410.04. Application for License. Any eligible
association desiring to be licensed shall apply in
duplicate to the License Inspector on a form to be
supplied by the License Inspector. Said application
shall be signed and verified by oath by the person
conducting, operating and managing said game for the
association, who shall be responsible for the conduct
and operation of the game and must see that the pro-
visions of the statute and this chapter are complied

association, notification of �such change must be made
and filed with the License Inspector within 30 days.
The application shall state the dates and times on
which permission to play is r'equested, a complete
listing of the names and add'resses of all members as
of the date of the application, and such other infor-
mation as the License Inspector may request and shall
be accompanied by an itemized record of all receipts
and disbursements of _the applicant organization for the
preceding calendar year, signed and verified by an
officer of the applicant organization.
410.05. Fire and Policle Approval. The ap-
plication� shall be referred to the Fire Department
and the Police Department, who shall report to the
City Council at its.'next regular meeting following the
filing of the application. Unless the Fire Chief and
the Chief of Police recommend the granting of the permit,
the City Council shall deny �the application. If the
Fire Chief and the Chief of Police recommend that the
permit be granted, the City Council shall take action
either granting or denying .the same.
- 410:06: Fees. P-ermit'�fees hereunder shall�be - �
Twenty Dollars ($20.00) for each date specified in the
application for the operation of the proposed bingo games;
and the aggregate permit fees as so computed shall be
submitted with the application.
410.07. Revocation of License. Licenses issued
under this Chapter may be revoked by the City Council
at any time, and may be revoked for failure to comply
with any provisions of this Chapter or any other section
of the Saint Paul Legislative Code, the City Charter,
or State Statute, directly or indirectly pertaining to
bingo. ,
410.08. Limitation on Rent. Reasonable charges may
be paid by an organization' conducting bingo for rent of a
hall or other place in which to conduct bingo, for rental
of bingo cards and other equipment and for maintenance and
janitorial service, but such charges shall not exceed a
total of $60.00 per four-hour session, except that for good
cause shown, the Council, upon the recommendation of the
License Committee, may by resolution, approve a higher
rental fee. Al1 leases or rental agreements must be in
writing and a copy filed with the License Inspector. �

410.09. Time and Place� Limitations. No permit
shall be issued allowing bingo to be conducted more
than once per week by the same organization, or more
than 14 times per week at the same premises, or for a longer .
period than four consecutive hours on any one day, or within
a period of more than one year from the date the permit is
issued; provided, however, that when an application requests
a permit hereunder for not more than one week' s duration,
on condition that the permittee will not apply for or receive
another bingo permit within� the succeeding eleven months,
the Council, in its discretion, may issue a permit to such
applicant for more than one day or for every day of said
week. At the expiration of the year applied for, the
applicant shall, if it is desired to conduct further bingo
games on the same premises, file a new application which
shall take the course of the original application.
410.10. Members Only to Operate Bingo. The game
of bingo can be conducted only by the members of the
association. No member shall receive any compensation
in excess of $8.00 per bingo session for his services
in conducting, assisting in conducting or operating
said game, from which required Social Security taxes
and withholding taxes shall be deducted. No person
shall so assist in operating the game unless he shall
� - - have been, and shall be, a member or the spouse of a
member, in good standing of said organization. Every
person, while helping in the operation of any bingo game,
• shall carry a membership card or other certificate showing
that he is a member or spouse of a member in good standing
of the sponsoring organization. No person may operate or
assist in the operation of� more than two bingo games in
any one week.
- 410.11. Advertising Restricted. No person shall
advertise the playing of the game of bingo, except that
not more than two signs, each not to exceed the dimensions
� of 2 by 4 feet, may be displayed on the building where the
game of bingo is being played, containing only the words
"Bingo Played Here" , together with the name of the licensee
and the day and hour of such playing, provided, however,
that such organizations shall not be prohibited from cir-
cularizing their own membership respecting such bingo games.

410.12. Free Lunches, etc. Prohibited. No free
lunches, food or merchandise shall be offered .or given,
nor shall other inducements for game participation bs

made by anyone.

410.13. Liquor and Minors. No liquor or 3.2/ ,
beer shall be sold, served or consumed in the room
where the bingo game is conducted; and no person
under the age of eighteen years shall be allowed
in said room while said game' is conducted.

� 410.14. Prizes. Award of prizes made in con-
nection with the conduct of said game shall not
require prior participation in a bingo game; and
no single game prize, or total prize shall be
awarded in an amount exceeding Fifty Dollars ($50.00) .
410.15. Reporting. Each organization con-
ducting bingo, within three days of each bingo
session, shall submit to the License Inspector,
�on a form to be furnished by the License Inspector,
the following information for each game played:
, l. Total number of cards sold;
2. Total amount of money collected;

, ti 3. Amount paid out in prizes;
' 4. Names and addresses of all persons helping
., in the operation of the game, together
� with amount of compensation paid to each
' and amount of State and Federal income tax and
Social Security tax.withheld for each;
5. . Amounts and recipients of all other disburse-
ments.

410.16. Record of Receipts of Charities. Each
organization having received a permit for the playing
of bingo shall keep on the premises where the games
are played accurate and complete books and records of
all receipts and disbursements including the names of
associations or charities to whom disbursements are
� made, and the amounts and dates of such disbursements;
and shall make such records available for inspection
by the License Inspector upon request.

410.17. Game Conduct and Procedure. Subd. 1.
All bingo games shall- be conducted in full view of
the public and all accounting for and changing of
money shall take place in the same room or hall in full
view of game participants. �
Subd. 2. The selection and calling of numbers shall
be in view of game participants and all numbers called
shall be determined by chance by use of a fix-proo� device
of a kind approved by the License Committee.
. 410.18. Penaltv for Violation. Any person, as
defined in Section 501.16 violating any provision of
this Chapter or who intentionally aids, advises, hires,
counsels or conspires with or otherwise procures another
to violate any provision of this chapter shall be guilty
of a misdemeanor and upon conviction shall be punished by
a fine not to exceed $100 or by i.mprisonment not to exceed
90 days. '
Section 2. This ordinance shall take effect and be in force
thirty days after its passage, approval, and publication.

provided in Subd. 1 to other duly qualified organizations,
provided that the proceeds from said lease or rental do
not inure to the benefit of any individual, but in no .
case shall bingo be played more than ': 14 �.. times per week
at any one premises or location. All organizations renting '
or leasing premises for the playing of bingo as provided in
Subd. 1 shall file proof of ownership with the License
Inspector.. � ,
Subd. 3. Notwithstanding the provisions of Subd. 1, . '
a duly qualified organization may be issued a license
' hereunder for not more than one week' s duration for more
than one day or for every day of said week on condition
that the licensee will not be issued another bingo permit
within the succeeding eleven months. ,

410.13. Liquor and Minors. No liquor or 3.2%
beer shall be sold, served or consumed in the room
where the bingo game is conducted; and no person
under the age of eighteen years shall be allowed
in said room while said game is conducted.
410.14. Prizes. Award of prizes made in con-
nection with the conduct of said game shall not
require prior participation in a bingo game; and
' - no single game prize, or total prize shall be
awarded in an amount exceeding Fifty Dollars ($50.00) .
410.15. Reporting. Each organization con-
ducting bingo, within three days of each bingo
session, shall submit to the License Inspector, _
on a form to be furnished by the License Inspector,
the -following information for each game pla�red: �
; l. Total number of cards sold; �
2. Total amount of money collected;
• 3. Amount paid out in prizes; .
. 4. Names and addresses of all persons helping
in the operation of the game, together
with amount of compensation paid to each
. and amount of State and Federal income tax and
' Social Security tax withheld for each;
5. Amounts and recipients of all other disburse-
ments. �
_ 410.16. Record of Rece�ipts of Charities. Each
organization having received a permit for the playing
of bingo shall keep on the' premises where the games
are played 'accurate and complete books and records of
all receipts and disbursements including the names of
associations or charities to whom disbursements are
made, and the amou�ts and dates of such disbursements; '
� aaid shall make such records available for inspection
by. the License Inspector upon request.

410.17. Game Conduct and Procedure. Subd. 1.
All bingo games shall be conducted in full view of
the public and all accounting for and changing of
money shall take place in the same room or hall in full
view of game participants.
Subd. 2. The selection and calling of numbers shall �
� be in view of game participants and all numbers, called
shall be determined by chance by use of a fix-proof device
" of a kind approved by the License Committee.
� 410.18. Penalty for Violation. Ariy person, as
defined in Section 501.16 violating any provision of
this Chapter or who intentionally aids, advises, hires,
counsels or conspires with or otherwise procures another
to violate any provision of this chapter shall be guilty
of a misdemeanor and upon convictiori shall be punished by •
a fine not to exceed $100 or by imprisonment not to exceed
90 days. � '
• Section 2. This ordinance shall take effect and be �.n force
thirty days after its passage, approval, and publication.

Dear Mayor Byrne and Gentlemen:
You presently have before you for consideration a proposed ordinance,
being Council File #235773, which is an amendment to the bingo ordinance. This
proposal is an improvement over the original draft, but still leaves many
questions unanswered and is discriminatory in its application.
For example:
1. The maximum rental chaxge pursuan.t to �+10.08 of the proposed
ordina.n.ce is �60.00 per session, but that for good cause shown the Council
may, upon recommendation of the License Committee, approve a higher rental.
This section attempts to impose rent control with an escape clause that is
not f�unded on any recognizable standard other than the words "except for
good cause shown".
2. Bingo is restricted to any one location to not more than two
sessions per week, with the exception that a religious, charitable or fraternal
organization that is non-profit and owning a hall may lease it to other qual-
ified organizations up to l�- times per week for bingo. This restriction,as
contained in Subdivision 2 in proposed Section �+10.09, would operate against
all existing halls where bingo is played more than two times per week, except
the Knights of Columbus which, through its North Stas Building Corporation,
owns the hall in which it is located. This provision could lead to varying
subterfuges to indicate sale of a hall, such as a sale at an inflated price
with but a nominal down. payment and terms that would in 'fact amount to rental,
or purchases by contract for deed with a ',small down payment and a high pur-
_ chase price. A substantial question exists as to whether the requirement
that the hall must be owned by a non-profit religious, chaxitable or fra.�ernal
organization is not a denial of due process and equal protection of the laws
both of which are guaranteed by the State and Federal Constitutions. Many
worthy religious, chaxitable and fraternal orga,nizations are presently rent-
ing halls which are owned by individuals� or non-qualifying corporations,
• and the passage of this ordinance in its� present form will effectively deny
them income that they have been receiving in the past from this activity.
The Knights of Columbus hall is already booked to the maximum �1�+ ga.mes)
as allowable under the proposed ordinance.
3. The proposed ordinance still does not reach the heart of the
matter; that is, there is no requirement that a.n.y amount of money be

contributed for religious or charitable purposes, and it is this goal that both
state and local laws are intended to assist. It is respectfully suggest that
Subdivision 2 of proposed Section �+10.09 be amended to read:
'�A religious, chaxitable, fraternal, or other association, not
organized for pecuniary profit, and duly existing under the laws
of the State of Minnesota a.nd owning or leasing szitable premises
- may lease or rent such premises for the purpose of playing
bingo � � �.", '
and that a new Subdivision 5 be added to read as follows:
"Notwithstanding the provisions of Subdivisiors 1: and 2, no
organization hereunder shall be re-issued a license to conduct
further bingo games unless it has contributed during the preceding
• year a sum of not less than 5� of the total money collected in the
operation of its bingo games to a religious, chaxitable or ��f�aternal
organization, not organized for pecuniaxy profit, and duly existing
under the laws of the State of Minnesota." .
If the foregoing proposed changes were adopted, the so-called bingo
landlord would be elimin.ated, as the owner or prime tenant would have to be a
qualifying religious, chaxitable or fraternal organization, an.d secondly, there
would be some concrete assuran�;e that a portion of the proceeds would be con-

tributed to a proper cause. ' „ . _" .
Section �+10.15 of the proposed ord.inance is excessive in its book- -
keeping requirements, paxticularly as to Sections �+, 6 and 7; haviiig im m�d
that this section requires all this information to be filed within three days
of each game played. Subdivision 5 requiring the names and adc]resses of persons
winning prizes of $50.00 or more, is both unnecessary and unreasonable, and
would only serve to chase the bingo -players out intb' the su.burbs under a feax
of incurring tax obligations, as�they would' be subject to tax on their winnings,
but would have no proo�' as to their offsetting losses. ,
With the foregoing exceptions, the proposed ordinance is a substantial
improvement on the existing law, and, as previously stated, is an improvement
on the first draft of the ordinance as presented by the Office of the Corporation
Counsel. Frankly, many of the organizations on whose behalf I appeared at the
initial hearing on this matter are favorably disposed towards the proposal, as
they are lessees in the K.C. Ha11 and would be permitted to continue under this
draft. However, other organizations who axe renting different halls would be
left out and the number of games authorize��d. substa,n.tially reduced.
It is submitted that no problems� exist in the field of bingo that
proper enforcement of the law could not control. The present license rates for
bingo and the number of games being played will bring the City some $70,OOO.QO
in revenue. If an added inspector were authorized in the License Inspectorts
Office at a cost of less than 10� of the revenues received by the City, abuses
could be curbed and the game of bingo be permitted to continue with the ultimate
beneficiaries being the religious, chaxitable or fraternal organizations that
the l.a,w intended to benefit. �
