2 File Nuxnber 42-2004, public properties hereinafter described are hereby vacated and discontinued as
public property:

The property to be vacated is described as follows:
Edgmont Street lying south of a line from the northeast corner of Block 1 to the northwest corner
of Block 2, Clazke's 2" Addition to the City of Saint Paul, and lying north of the north line of
Wheelock Parkway as platted by the Board of Park Commissioners under resolution of said
board adopted January 6, 1908.
BE IT FITRTHER RESOLVED, that, this vacation shall be subject to the terms and condition of
Chapter 130, codified Mazch 1, 1981, of the Saint Paul Legislative Code as amended, and to the
following conditions:

That the petitioner's, their successors and assigns shall pay $600.00 as an administrative fee for
this vacation which is due and payable within 60 days of the effective date of this resolution.
That a permanent utility easement shall be retained on, over, under and across the vacated area on
behalf of the County of Ramsey, Department of Pubiic Works to reserve the right of the County
to maintain and operate any sewer in or upon said easement and to enter upon said easement or
any portion thereof at any time and from time to time, for the purposes of future construction,
reconstruction, inspecring, maintaining ar repairing the same or any part thereof. Any
development or use of the property shall be subject to the following conditions:
a.
No buildings, structures, trees or any temporary structure, material storage, fixture, or any
other objects that will prohibit normal access to utility facilities for maintenance purposes
will be permitted within the easement area.

b. Improvements in or upon the above described easement that do not prohibit the County
from exercising its reserved rights may be allowed by obtaiuing written pernussion from
the Department of Public Works Sewer Division with the understanding that the
restoration and costs of such improvements shall be the sole responsibility of the
petitioner, its successors and assigns in the event the County exercises its reserved

County of Ramsey, its officers, agents, employees, and servants from all suits, actions, or
claims which shall arise from any injuries or damages received or sustained by any break
in any service pipe or connection in said reserved easement arising out of or resulting
from any action or negligence of the petitioner, its employees, agents, or business
invitees.
That any access to the properiy from Wheelock Parkway will require the petirioner to apply for
access through the Parkland Diversion process.
That the petitioners, their successors and assigns agree to indemnify, defend and save harmiess
the City of Saint Paul, its officers and employees from ail suits, actions or ciaims of any chazacter
brought as a result of injuries or damages received or sustained by any person, persons or
properiy on account of this vacarion or petitioners' use of this property, including but not limited
to, a claim brought because of any act of omission, neglect, or misconduct of said petitioners or
because of any claims or liability arising from any violarion of any law or regulation made in
accordance with the law, whether by the petitioners or any of their agents or employees.
That the peritioners, their successors and assigns shall, within 60 days of the effective date of this
resolution, file with the City Clerk an acceptance in writing of the conditions of this resolution
and shall, within the period(s) specified in the terms and condiflons of this resolution, comply in
all respects with these terms and conditions.

Larpenteur Avenue and Wheelnck Parkway.
I am requesting a date of Apri120, 2005 for a Public Hearing to approve the attached
Council Resolution. The purpose of the resolution is to approve the petition of the
Renovation Inc. to vacate Edgmont Street between Larpenteur Avenue and Wheelock
Parkway. I have enclosed photocopies of the Green Sheet, the Council Resolution and a
map of the area to be vacated. Please let me know if there is any additional informafion
you might need.
The resolution is currently being routed for signatures along with the responses from the
utilities and other pertinent information.

The Department of Public Works has completed a review of the above referenced vacation and
has no objections subject to the following:
1) This is an unimproved street with a Ramsey County storm sewer running down the center line
of the street from Larpenteur, then easterly across the south half of I.ots 4 and 13, Block 2,
Clarke's 2° Addition, then southeasterly to our pond at Arkwright. Ramsey County Public
Works needs to review this vacation proposal. An easement over the north half of Edgemont
Street will probably be needed for their storm sewer line, and it looks like the south haif of
Edgemont Street may be needed for ponding. Pve attached a copy of a portion of Ramsey
County's sewer construction plan for this location.
2) If the street is vacated, the City Surveyor recommends the following be used as the vacation
description:
Edgemont Street lying south of a line from the northeast corner of Block 1 to the northwest
corner of Block 2, Clarke's 2n Addition to the City of St. Paul, and lying north of the north line
of Wheelock Pazkway as platted by the Board of Park Commissioners under resolution of said
board adopted January 6, 1408.
3) If the petitioner is intending to build a single family home on the vacated street, easements will
need to be released. Please send me a Certificate of Intended Non-Use so I can get it signed.

LIEP has no objections to the proposed vacation.
You may want to pass this information on to somebody if they want to build a house or two in the right of way
once it is vacated:
The right of way contains a low spot that some of the surrounding property drains into. I think the drainage will
still work if somebody wants to build a couple of single-family houses (one facing Larpenteur and one facing
Wheelock). But LIEP or Public Works may ask the property owner for some additional analysis of drianage if
they come in to get a permit to build a house.
