05-348Retum copy to: (BJE) Real Estate Division 140 City Hall RESOLUTION Council File # ��� Green Sheet # 3026067 SAINT PAUL, MINNESOTA Presented By Referred To Committee: Date SS 1 WHEREAS, the City of Saint Paul ("City") has determined that there is no longer a public purpose for 2 owning a parcel of surplus land along the northeast side of Eaton Street, Saint Paul, which was purchased 3 several yeazs ago for the City's flood control project; and 4 5 WHEREAS, the City wishes to vacate its interest in this property; and 6 7 WHEREAS, the City has received a request from the Deparhnent of Planning and Economic Development 8("PED") to convey the properry to the Housing and Redevelopment Authority of the City of Saint Paul, 9 Minnesota ("HRA") for development of a new funeral home to serve the city's Hmong population; and 10 11 WHEREAS, PED has determined that such comeyance will support public development efforts; now, 12 therefore be it 13 14 RESOLVED, that, upon the petition of the City of Saint Paul, as documented in Public Works File Number 15 01-2005, the public property herein described is hereby vacated and discontinued as public properry: 16 17 That part of Lot 8, Block 3, Riverview Industrial Park No. Il, described as follows: 18 19 Part of Lot 8 Block 3 described as beginning at the Southeast corner of said Lot; thence along the East 20 line of said Lot a distance of 186.36 feet; thence Southwesterly to a point on the Southwesterly Zine of 21 said Lot a distance of 160 feet Northwesterly from the point of beginning; thence Southeasterly to the 22 point of beginning; and a11 ofLot 7 Block 3. 23 24 and be it further 25 26 RESOLVED, that the Council of the City hereby authorizes the proper city officials to convey the vacated 27 property by Quit Claim Deed to the HRA. 28 29 This vacation shall be subject to the terms and conditions of Chapter 130, codified Mazch 1, 1981, of the 30 Saint Paul Legislative Code as amended, and to the following conditions: 31 32 33 34 35 36 37 That the stockpile of semi-permeable soil that the Aepaztment of Public Works has on its current properry bordering Eaton Street (Properry ID No. OS-28-22-43-0035) shall be moved by the developer of the Hmong Funeral Home project and placed on the inside radius of Eaton Street and the West Lafayette Frontage Road, in the southeast corner of Lot 5, Block 3, Riverview Industrial Park No.l l. The stockpile shall remain 10 feet back from the curb line. The developer shall finish off said relocated stockpile with four inches of topsoil and seeded with grass. 2. That the Department of Public Works shall relinquish ownership of the remainder of the stockpile at the previous locarion, which may be used by the developer or the Saint Paul Port Authority in the development of the Hmong Funeral Home project, or disposed of as the developer sees fit. 3. That the developer shall convey land to the City for the azea where the stockpile has been relocated. 4. That the developer shall grant the City a street easement for the area 10 feet back from the curb line along Eaton Street. 5. That the developer shall submit a survey showing and describing the conveyance and easement required in the above conditions #3 and #4. 6. That an independent appraisal of the City's cunent property shall be conducted to determine its fair market value. An independent appraisal of the property conveyed to the City by the developer shall be conducted to determine its fair mazket value. The developer shall pay to the City an amount equal to the difference in value between the CiTy's current property and the developer's property. 7.
