WI�REA.S� The State of Minnesot��, Departmen-t of HighVaays, in connection with
a certain improve�ent of T.H. ;�1�� in tZamsey County from Larpenteur Averrue
' to T.H. #36, did acquire certain limited easenents from the B�ard of Water
Corrunissioners by agreement executed 23 July 191�7; and
WHEREA�S� '�he State was allowed to uge ditch in said easement to drain all
flows to any boundary of Tract 6 ar.d Tract 7 and thence convey the flow of
same to and discharge same inta so-called Trout Br�ok Sewer; and
t^JHEREA.S� The State agreed to certa.in conclitions in said agreement that wauld
allow the Board to place fill m��t,erials over Tract 6 and that upon proper
notification by t,he Board the State would i.nstall an adequate underground
� dr�.inage system as may be necesgary in place of the ditch; and
T��REAS� Due to the unatable subsoil conditions in Tra.ct 6, it is necessary
� to constxuct the said drainage system in a location other than that covered
� by ths original agraement. It is, therefore� the recammendation of t1�C}eneral
� Mana.ger that a new easement be granted to ths State, by supplemental agreement,
, for construction of said drainage system and that the�tate sha71 Quit Claim
_; its interests in that port3on of Tr:ct 6 not includedl e new easement granted
i by said supplemantal agre�ment.
NQr7� THEREFORE� HE IT A(iI�D, That the Board. concurs in the QeZeral Manager's
reco�anendation and th,at the proper officers are hereby authorized and directed
. to execute this agreement. .
