THE COUNCIL OF THE CITY OF SAINT PAUL DOES ORDAIN:
Section 1. That the Zoning Code, Chapters 60 to 6�+, inclusive,

Height Districts, and Rezoning of certain properties in the City
of Saint Paul, as amended, be and �he same is hereby further
amended so as to rezone the following described property from

This is in response to the Petition of Ronald D. Soderberg to rezone
from "B" Residence to "C" Residence property on the east side of
Mackubin Street between Maryland and Jessamine Avenues. The property
is further described as Lots 56, 57, 58, � 59, Wilkin � Heywards out-
lots, subject to Mackubin Street, lying west of Block 4, Soderberg's
Second Addition. ; -
� This matter was considered at the September 7, 1967 Board of Zoning
meeting. The staff reported that the area south of Maryland Avenue
is zoned "B" Residence except for the s�outheast corner of Maryland
Avenue and ATorton Street and the southwest corner of Maryland Avenue
and Cumberland Street whi�h are zoned "C" Residence. To the north,
across Maryland Avenue, is. zoned a mixture of "B" and "C" Residence
and Commercial. Sai.nt Paul's Comprehensive Plan recommends R-3
(single-family residences) for this property and the area to the east
and south.. The site is. vacant and slightly below street grade.
Presently,to the west of the property is a small lake (Loeb Lake) in
the process of being filled. Immediatelly adjacent to the north and
south are single-family residences� to the east are a number of
recently constructed duplexes. (
It was the finding of the Board that the proposed rezoning does not
agree with the recommendations of the Comprehensive Plan, that the � ,
surrounding area is single and two-family in character, and that
rezoning would constitute "spot zoning.�"
Consequently, the Board of Zoning recommends denial of the app.lica-
tion to rezone this property from "B" Residence to "C" Residence.

� Gentlemen:
A hearing was held on October 5, 1967,
on the petition of Ronald D. Soderberg to rezone from "B" resi-
dence to 'iC" residence that part of Zots 56, 57, 58 ana 59, Wil-
kin and Heyvrards Outlots. �
In checking the notification roll we
find that the west 100 feet of Zot 60, Wi]liin and Heywaxds Out-
lots, subject to Maryland and Mackubin Streets, was erroneously
listed in the name of the City of St. Paul. Inasmuch as this
paxcel immediately adjoins the property petitioned to be re-
zoned, and the owner thereo�' was not notified of the heaxing,
the matter was discussed with Mr. Stearns of the Corporation
Counsel's staff, who recommended that the matter be re-heard.
We have also contacted Mr. Heiden who
requested that, if a re-hearing is scheduled, it should not oc-
cur before November 2 because of a scheduled Zoning Board meet-
ing with reference to the Loeb La.ke area in which the paxcel
involved is located. � �

If the Council's decision is to re-hear
this matter, I would reco�►end that�: Mr. Soderberg be advised at
the earliest possible date in order� that no work will be under-
taken as a result of the Council�action on October 5.
