1 WHEREAS, the City of Saint Paul ("City") has detennined that there is no longer a public purpose for
2 owning surplus right of way abutting city-owned property at 465 Wacouta Street; and
4 WHEREAS, the City wishes to vacate its interest in this right of way; now, therefore be it

6 RESOLVED, that, upon the petition of the Housing and Redevelopment Authority of the City of Saint
7 Paul and the City of Saint Paul, as documented in Public Works File Number 17-2004, the public
8 property herein described is hereby vacated and discontinued as public property.

10 That part of Wacouta Street originally dedicated as Meeker Street in the plat of HOYT'S ADDITION TO
11 ST. PAUL, according to the recorded plat thereof, Ramsey County, Minnesota, described as follows:

Beginning at the most northerly corner of Outlot A, SIBLEY PARK APARTMENTS 2ND ADDITION,
according to the recorded plat thereof, Ramsey County, Minnesota; thence northeasterly on the
northeasterly prolongation of the northwesterly line of said Outlot A, a distance of 19.10 feet; thence
southeasterly a distance of 17.85 feet along a tangential curve, concave to the southwest, having a
radius of 9.00 feet and a cenh-al angle of 113 degrees, 38 minutes 25 seconds; thence southeasterly
along a reverse curve , concave to the east, having a radius of 368.26 feet, delta and arc Zength to the
northeasterly line of said Outlot A; thence northwesterly to the point of beginning and there terminating.
This vacation shall be subject to the terms and conditions of Chapter 130, codified March l, 1981, of the
Saint Paul Legislative Code as amended, and to the following conditions:
1.That a permanent sewer easement shall be retained on, over, under and across the vacated area on
behalf of the City of Saint Paul, Department of Public Works. Said sewer easement shall be
subject to the following conditions:
28 a. No buildings, structures, trees or any temporary structure, material storage, fixture, or any
29 other objects that may prohibit normal access to utility facilities for maintenance purposes
30 will be permitted within the easement azea.

32 b.Improvements in or upon the above described easement that do not prohibit the City from
33 exercising its reserved rights may be allowed by obtaining written permission from the
34 Department of Public Works Sewer Division with the understanding that the restoration and
35 , costs of such improvements shall be the sole responsibility of the petitioner, its successors
36 and assigns in the event the City exercises its reserved easement rights..

f. That the re-alignznent of the curb and other improvements in the right-of-way on the west
side of Wacouta Street shall be accomplished by the Department of Parks and Recreation
under a permit issued by the Department of Public Works.
2.That a permanent utility easement shall be retained on, over, under and across the vacated azea on
behalf of the Board of Water Commissioners of the City of Saint Paul to reserve the right of the
Board to maintain and operate any water facility in or upon said easement and to enter upon said
easement, or any portion thereof, at any time and from time to time, for the purposes of future
construction, reconstnxction, inspection, maintenance or repair of the same, or any part thereof.
Said utility easement sha11 be subject to the following requirements:
a. No buildings, structures, trees or any temporary shucture, material storage, fixture, or any
other objects that may prohibit normal access to water facilities for maintenance purposes
will be permitted within the easement azea.
b.Improvements in or upon the above described easement that do not prohibit the Board from
exercising its reserved rights may be allowed by obtaining written permission from Saint Paul
Regional Water Services with the understanding that the restoration and costs of such
improvements shall be the sole responsibility of the petitioner, its successors and assigns in
the event the Board exercises its reserved easement rights.
c. Should it be necessary that the petitioner's works or improvements be removed or damaged
as a result of the Saint Paul Regional Water Services operations, a11 removal, replacement or
modification costs shall be borne solely by the petitioner.

agents, employees, and servants from all suits, actions or claims that shall arise from any injuries
or damages received or sustained by any break in any service pipe, water main, or connection in
said reserved easement, arising out of or resulting from any action or negligence of the petitioner,
its employees, agents or business invitees.
3.That easement rights be reserved in favor of Northern States Power Company, d.b.a. Xcei
Energy, within the vacation azea to acconunodate existing electric distribution facilities.
4. That easement rights be reserved in favor of Qwest Corporation within the vacation area to
maintain utility rights for any e�cisting facilities.
S.That the petitioners, their successors and assigns shall, within 60 days of the effective date of this
resolution, file with the City Clerk an acceptance in writing of the conditions of this resolution
and sha11, within the period(s) specified in the terms and conditions of this resolution, comply in
all respects with these terms and conditions.

The Department of Public Works has completed a review of the above referenced vacation. This is an
improved street with existing power poles within the vacated area. We have no objections subject to the
following conditions.
1) The surveyor needs to make a few changes to the legai description. See attached red-lined
description.
2) That a permanent sewer easement shali be retain on, over, under and across the vacated area on
behalf of the City of Saint Paul, Department of Public Works. Said sewer easement shall be subject to the
following conditions:
a. No buildings, structures, trees or any temporary structure, material storage, fixture, or any
other objects�which may prohibit normal access to utility facilities for maintenance
purposes will be permitted within the easement area.
b. improvements in or upon the above described easement that do not prohibit the City from
exercising its reserved rights may be allowed by obtaining written permission from the

bythe Department of Pubiic Works.
