record in <the office of tY�e Register
of Deeds in and �or Ramsey County,
- State of Minnesota.
WHEREAS, Pursuant to resolution, C. F. 234873, approved
August 31, 1967, a public hearing was duly held on Tuesday,
September 19, 1967, before �the Cou.ncil of the City of Saint Paul,
said hearing pertaining to the condition of the sixucture located
at g44 Payne Avenue, Sa2nt Paul, Minnesota; and
WHEREAS, Upon the facts presented at the said hearing
consisting of photographs, inspection reports and the recommenda- '
tion of the City Architect, it is found and determined by the
_ City Council that according to the records and files in the
office o� the Register of Deed.s, the last record owners of the
above-described property are Rose Properties, a co-partnership
consisting of Walter F. Stepnitz and Arnold Kramber, that
Minneapolis Savings and Loan Association is tYie mortgagee, and
that there are no other lien holders o� record; that it is
further determined that the above-described building constitutes
. a hazardous building within the definition of Minnesota Statutes
Section 463. 15 for the following reasons:

RESOLVED, That in accordance with Min.nesota Statutes
Sections 463. 15 through 463. 26�, and based upon the foregoing
findings o� the City Coun.cil, the Coun.cil of the City of Saint
Paul does hereby make the following Order:

ORDER
1 : The own.ers of the above-described building shall make
� the same safe and not detrimental to the public health, safety
and welfare by having the said; hazardous building razed and the
materials therefrom removed from the premises within twenty (20)
days , from the date of the service of this Order.
l
2. Un.less such corrective action is taken to comply with
. this Order or an answer servediupon the City of Saint Paul and
- ' filed in the Office of the Clerk of the District Court of Ramsey
County, Minnesota, within twenty (20) days from the date of the
service of this Order, a Motion for Summary Enforcement of this
Order to raze and remove the said building .shall be made to the
Ramsey Coun.ty District Court. �

3. � In the � event�that the building is to be razred- by
the City of Saint Paul pursuant to judgment of the District
Court, all personal property or fixtures which may unxeasonably
interfere with the razing and removal of this building shall
be removed within ten (10) day`s from the entry of judgment;
and if not so removed, the City of Saint Paul shall remove
and dispose of such personal p{operty and fixtures as provided
by law.

4. If the City of Saint Paul is compelled to take any
corrective action herein, all necessary costs expended by the
City will be assessed against the above-described real estate
and' collected as are other tag,es ; and be it

-� The property at 944 Payne Ave�ue is a building us ed as commercial
���on the first floor and apartments on the second floor. It is two stories in
height, of frame construction and approximately 24 feet wide, 78 feet long
and 3 6 feet in 'height. The buildi.ng has only a partial bas ement.
�
At tlze present time the building is vacant and has been secured at
our request by the Department of Public Works under an emergency procedure.
The following speci.fic items have been reported by our field inspector
on an i.nspection made September 9, 19_67:
EX TERIOR '
The chimney is in a very hazardous condition. Approximately half of
it has fallen away already, and the other half is i.n danger of falling. When it
falls, it would fall on to public property. The windows are almost all broken,
the siding on the south side of the building is loose and rotted, t'he cornice
boards are rotted and lianging loose, and some siding has•been broken on t�he
north side. The basement is littered with debris. The supporti.ng posts are
rotting, the joists show evidence of rotting and some have been repaired in the
past due to the advanced rotti.ng. The i chimney s ection expos ed in the bas ement
h.as deteriorated and is in need of repair. T`he toi.let room in the basement
is not provided with any window or mechanical ventilation.

FIR.S T FLOOR �
On the first floor, which contains two rooms and a toilet room, the _
room at the front was used as a restaurant at one time. The walls have been
smashed, the floors are buckled and the floor tile nas been broken up. The
light fixtures have been removed and the floors are sagging. The plumbing

fixtures in the toilet room have been removed, as have t'he radiators. A room
at t'he rear has had the lig'ht fixtures removed from the ceiling and the plumbing
fixtures removed as well. The ceiling tile is falling.

SECOND FLOOR �
On t'he second floor, which contains six rooms and two toilet rooms, t'he
three rooms at the front of the building have wall tile buckled. The ceiling tile
is falling and tlzere is no ventilation in t'hes e three rooms as the glas s s as�i are
in fixed position, The toilet rooms lzave �had the plumbing fixtures removed and
the rooms do not have the minimum requirement of light and ventilation. There
is evidence that the room at the rear is� being damaged by a leaki.ng roof. The
ceiling tile is falling and the floors are�buckling. There is only one means of
egress from the second floor, where the building .ocle requires that living units
above commercial occupancy must be provided wi.t'h two means of egress.
� ATTIC � �
T`he attic is littered with debris' and approximately 25 per cent of the �
plaster in a room in the attic 'has fallen.
If it is the opinion of the owners of this property that it can be rehabilitated,
it will be necessary t'hat they submit the list of corrections which tliey propose regarding
the structural condition of the buildi.ng, as well as the electrical, plumbing and
heating systems, with a schedule for tlie completion of the rehabilitation program,
along with the application for permits, :
If the foregoing schedule is not submitted by the owners, it is the conclu-
sion of the Bureau of Public Buildings tliatby reason of inadequate maintenance,
dilapidation, physical damage, unsanitary condition and abandonment, the above
structure constitutes a hazard to public liealth, safety and welfare. It is the
further conclusion of the City Architect that they recomrriend that the Council
concur in t'his conclusion and refer the matter to the City Attorney�s office
for submi.ssion of this condemnation to the District Court.
