City of Saint Paul and situated
upon those premises legally des-
cribed as Lot 2, Block 12, part
of Brown. and Jackson' s Addition
to West St. Paul, according to
the plat on file and of record -
in the office of the Register of
Deeds in and for the County of
Ramsey, State of Minnesota.
WHEREAS, Pursuant to resolution, C. F. 235351, approved
October 11, 1967, a public hearing was duly held on Tuesday,
October 24, 1967 , before the Council of the City of Saint Paul,
said hearing pertaining to the condition of the structure
located at 309 East Congress Street, Saint Paul, Minnesota; and
WHEREAS, Upon the facts presented at the said hearing
consisting of photographs, inspection reports and the recommenda-
tion of the City Architect, it is found and determined by the
City Council that according to the records and files in th�e �
-°-office of the Register of Deeds, the _last rec.ord owners o� �;�he
p above-described property are John Basquez and Guadalupe •Basquez,
and that there are no other lien holders of record; that it is
further determined that the above-described building constitutes
�i' �° a hazardous building within the definition of Minnesota Statutes
o � Section 463. 15 for the following reasons:

a m a. Prior to October 11, 1967, the
� - building was standing open and abandoned and
subsequent to October 11, 1967, the City of
,�, � � Saint Paul took the necessary steps to board �
shut the building so' as to make it temporarily
� - safe;

stitutes a hazard to the public health, safety and
. welfare for the following reasons: the super
� structure of the dwelling is rotted, all sheet
rock is off the ceiling and� walls, the building
, has been partially damaged by fire, the foun.dation
walls ,are movi�ng inward cau'sed by soil pressure,
all roof and floor joists s�ag, the open trap door
creates a dangerous condition from the first floor ,
',. •to the basement, the chimney mortar joints are � -r�'
� .. .. �-- � eroded, ��he �stairways,- porches, roof� and, siding ,
ar�e all in an advanc'ed dila�adated condition, the � � " '
building has been vandalized, there are holes in
the roof, and the rafters are badly damaged, and , �
� further there is no plumbing, electrical and
heating facilities in the said buildi�ng; ,

� c. The building �in the above condition is �
beyond reasonable repair; � ,

d. The building �constitutes a nuisance and .
a hazard to the public health, safety and welfare
because of its physical damage, dilapidation, inade-
quate maintenance, and abandon.ment; `

RESOLVED, That in accordance with Minnesota Statutes Sections
463. 15 through 463. 26, and based upon the foregoing findings of
the City Council, the Council of the City of Saint Paul does
. hereby make the following Order;.

the same �safe and not detrimental to the public health, safety
and welf,are by having the said building razed., and� the ma'terials

the date of the service of this Order. '
2. Unless such correctiv'e action is taken to comply
with this Order or an answer served upon the City of Saint
Paul and filed in the Office of the Clerk of the District
Court of Ramsey County, Minn.esota, within twenty (20) days
from the date of the service of this Order, a Motion for
Summary Enforcement of this Order to raze and remove the
said hazardous building will be made to the Ramsey County
District Court.
,� 3. In the event.. that the building is to be razed by
` ' a . the City of Saint Paul pursuant to judgment of the District -
Court, all personal property or fixtures which may' unreasonably ,
interfere with"�the� razing and removal of this hazardous -�
building shall be removed within,ten (10) days from the entry
. of judgment; and if not so removed, the City of Saint Paul
shall remove and dispose of such ,personal property and fixtures
as provided by law. . � . � �

The Building Department is hereby submitting its report on the
condition of the property �.own as 309 East Congress Street, a single family
dwelling of frame construction, one story in height, containing a full
basement. The dimensions are 14 ft, wide by 45 ft, long. The owners of
record are John and Guadalupe Basquez, and the legal description is Lot 2,
Block 12, part of B�,own and Jackson's Adclition to West Saint Paul.
Recent inspection ind.icates that the building is in an ad,vanced state
of dilapidation and�has no plumbing or electrical connections. The chimney
bricks are loosened because of erosion of t�he mortar joints. The exterior
steps and porch roof are badly damaged due to the rotting of the wood. The
doors andfhe:window sashes are broken. T`he basement walls are in a dilapi-
dated cond.ition, with the west wall being pushed in and will soon be subject
to collapse.
The first floor, which contains four rooms, has been extensively
vandali�zed and partially damaged by fire. ' The plaster is off most of the
walls and cei.lings and there are �holes in the floor. The roof rafters are
� sagging and there are 'holes through the roof~:"'

If it is t�he opinion of the owners of�this property that it can be
re'habilitated, it will be necessary that they submit the list of corrections
which they propose regarding the structural condition of the building, as
well as the electrical, plumbing and heatirig systems, with a schedule for
the completion of the rehabilitation program, along with the application for
permits. ,

If the foregoing schedule is not submitted by the owners, it is the
conclusion of the Bureau of Public Buildings that by reason of inadequate

maintenance, d.ilapidation, p'hysical damage, unsanitary condition and.
abandonment, the above structure constitutes a �hazard to the public health,
safety and welfare. It is the further recoxnrnendation of the City Architect
that the Council concur in this conclusion and refer the matter to the City
Attorney's office for submission of this condemnation to the District Court.
