October 3, 1967, a public hearing was duly held on Thursday,

Probate Court for Ramsey County, Agnes Knapp (Miller) died in
� 1963; that according to the records of the Register of Deeds,

Street is Molly Alpert; and that a`ccording to the records of the
, Ramsey County Probate Court , Libby� Sigel is the guardian for
Molly Alpert; that according to the records of the Ramsey County
Auditor, the taxes for the subject property are delinquent; and
further that there are no other lien holders of record; that it .
is further determined that the above-des'cribed dupleg constitutes
a hazardous building within the definition of Minnesota Statutes
Section 463. 15 for the following reasons:
a. The building i-,s standing vacant, .
, abandoned and is subject t( entry by unauthorized

is in poor condition, the ;`;mortar joints have
eroded and are crumbling, the exterior stairways,
porches and railings are dilapidated, rotted and

� the windows and doors are broken and hanging loose �
� ' from the hinges, and there are signs� that the
i ,� building has b.een entered by unauthorized persons; � .

are damaged, floor boards are rotted, stairway
� railings have broken, toilets are broken, the

e. The building is beyond reasonable
repair; '
f. The building is unfit for human
habitation in its present condition and the
, above corrections must be made to comply with
the Saint Paul Building and: Housing Codes in
� order to make the same habitable;
g. The building constitutes a nuisance '
�and a hazard to the public health, safety and
i,relfare because of its physical damage, dilapi-
dation, abandonment and inadequate maintenance; �

RESOLVED, That in accordance with Minnesota Statutes
Sections 463. 15 , through 463. 26, and based upon the foregoing
findings of the City Council, the Council of the City of
Saint Paul does hereby make� the following Order:
. ORDER � .
l. The owners of the above-described building shall make
' " the same safe and not detrimental �to the public health, safety
� and welfare by having the said building razed and the materials
�.therefrom removed from the premises within thirty (30) days from
� ,the date of the, service of this Order or, in the alternative,
�`begin to correct the hazardous conditions and correct the
h.azardous conditions by doing the !following:
a. Remove all paper and other com-
bustible materials from the building and
aecurely close and keep closed all doors,
windows or other openings in the building;
, ;
b. If the building is to be used
for human habitation, all of the above defec-
� tive� conditions must be corrected and the -
wi,ing, plumbing and heating systems brought

ments of the Saint Paul Housing Code and
Building Code, and that the own.ers submit �
a list of intended corrections regarding the
structural condition of the building,
electrical, and heating systems, together
with a schedule for the completion of the
• rehabilitation program, and that the owners
apply for the necessary permits in the
office of the City Architect within the
thirty (30) days imposed herein..
2. Unless such corrective action is taken. to comply with
. this Order or an answer served upon the City of Saint Paul and
filed in the Office of the Clerk of the District Court of Ramsey
County, Minnesota, within twenty (20) days from the date of the
-service of this Order, -a Motion, for_ Summary Enf.orc.ement of ..this.�•••- _

3. In the event that the building is to be razed by' the
City of Saint Paul pursuan.t to judgment of the District Court,
all personal property or fixtures which may unxeasonably inter-
fere with the razin and removal of this building shall be
removed within ten �10) days from the entry of judgment; and
if not so removed, the City of Saint Paul shall remove and
dispose of such personal property and figtures as provided by
law.
� 4. If the City of Saint Paul is compelled to take any
corrective action herein, all necessary costs expended by the
C�,ty will be assessed against the above-described real estate
and collected as other taxes; and be it

Gentlemen:
T`he property at 217-219 McBoal Street was inspected on October 18,
1967. The property is classi.fied as a duplex, is of frame construction with
_ a brick veneer exterior. It is approximately 2-1/2 stories in heig'ht and
has a full basement of stone construction. ; The building is approximately
46 ft, wide, 50 ft, long and 30 ft, in height.

The exterior brick work is in very poor condition. Much of t�he
mortar joints have eroded and are crumbling. The exterior stairways,
porches and railings are dilapidated and rotted to the point vcihere they are
dangerous to use. There is evidence tlzat�the roof is leaking. The cornice
trim boards are rotting and some are falling from t'he building. Most of
the windows and doors are broken and�hanging loose from the hinges. The •
basement is littered wit'h debris and the mortar joints on the stone foundation
have eroded and are falling from place. The basement floor is badly
cracked and the stairway is in a dilapidated condition.
On the first floor, all rooms �have been extensively vandalized and
� debris is strewn in all rooms, The plaster is falling off the walls in many
areas. The doors are all broken. The cabinets in the kitchen have been
damaged and partly pulled apart. The floor boards are showing evidence of
rot. T`he stairway hand railings have been torn out. The toilet fixtures are
broken and some of the drain piping �has been removed.
On the second floor, both the front and rear stairways are badly
dilapidated and much of the railings are missing. All rooms are vandalized '
and there is evidence that most of t'he flooring �has started to rot. The .
. plaster t'hroughout �has either cracked or fallen from the walls. The plumbing
system is for all practical purposes out of service. Almost all of the
fi.xtures �have been broken or parts removed. The electric system has been

disconnected. The �heating system was via space heaters vcihich have all
been removed or �have been vandalized. �
' If it is the opinion of the owners of�this property t'hat it can be
rehabilitated, it will be necessary that t'hey�submit the list of corrections
tivhic'h they propose regarcling the structural condition of the building, as
well as t�.e electrical, plumbing and 'heating systems, �`with a schedule for
the completion of the rehabilitation program, along wit'h the application for
p e rmits.
If the foregoing schedule is not submitted by the own.ers, it is the
conclusion of the Bureau of Public Buildings that by reason of inac].equate
maintenance, dilapidation, physical damage, unsanitary condition and
abandonment, the above structure constitutes a �hazard to public 'health,
safety and welfare. It is the further recommendation of the City Architect
that t'he Council concur in this conclusion and refer the matter to the
City Attorney�s office for submission of this condemnation to the District
Court. �
