WHEREAS, the Legislative Aearing Officer recommended that the license applicafion (ID # 20040005464) for
Gas Station, CigazettelTobacco, and Retail Food-Grocery licenses by Kalcu. Investments, Inc., doing business as
Kaku Investments, 778 Smith Avenue South, be approved with the following conditions:
1. A11 deliveries shall take place between the hours of 7:00 a.m. and 10:00 p.m.
2. Garbage pick-up shall take place between the hours of 7:QQ a.m. and 1Q:0� p.m.
3. Provide physical screening far the dumpster according to the site plan on file with LIEP, by May 31,
2005.
4. Install a physical barrier between the shed and the main building and the shed and the southerly fence, as
shown on the site plan on file with LIEP, by May 31, 2QQ5.
5. Install a physical barrier (i.e. fence, pylons, busnpers) along the a11ey as shown on the site plan on file
with LIEP, by May 31, 2005.
6. A copy of the Phase 1 Environmental Study must be submitted to LIEP prior to the issuance of the
licenses.
7. Gasoline storage tanks must be certified by a qualified testing company. This certification must be
submitted to LIEP prior to the issuance of the licenses.
8. Licenses will be reviewed by LIEP inspectors in six months for compliance with all license conditions.;
THEREFORE, BE IT RESOLVED that the Council of the City of Saint Paul hereby approves this license
application with the aforementioned conditions.
