WHEREAS, since 1976 the City has, originally through Lease Agreement CS/30 and subsequently through
Lease Agreement PR/10, leased from the State Department of Transportation a parcel of land adjacent to the
Cayuga Playground, which it has incorporated into the said playground; and
s WHEREAS, the said Lease Agreement PR/10 will expire on Apri130, 2005; and
WHEREAS, it is the intention of the parties to the said Lease Agreement PR/10 to extend the term of the
lease through April 30, 2008;
�o THEREFORE BE IT RESOLVED, that the proper City officials are hereby authorized and directed to
� � execute a three year extension to said Lease Agreement PR110.

Effective on May 1, 2005, Section 2 of the Lease is deleted in its entirety and the following is substituted
in lieu thereof:
AMENDMENT OF COMMERCIAL LEASE
No. 3
THIS AGREEMENT, is made by and between the State of Minnesota, Department of Transportation
("Landlord") and The City of Saint Paul ("TenanY'), and shall be an amendment and addition to Lease No. H-
05895.
WITNESSETH:
WHEREAS, Landiord and Tenant entered into Lease No. H-05895 ("Lease") involving the rental of commerciai
land;
WHEREAS, the parties deem certain amendments and additional terms and conditions mutually beneficial for
the effective continuation of said Lease; and
NOW THEREFOR, Landlord and Tenant agree to substitution and/or addition of the following terms and
conditions which shall become a part of the Lease No. H-05895, efFective as of the date set forth hereinafter.
Effective on May 1, 2005, this Lease No. H-05895 shall be renewed for a period of Three (3) years
commencing on May 1, 2065 and continuing through Aprif 30, 2408, witfi the right of termination by both
Landlord and Tenant as set forth.in the Lease.

2. RENT. Tenant shall pay to Landlord as rent for the Premises the sum of One Thousand Eight
Hundred Ninety and No1100` Doilars ($1,890.00) in annual payments of Six Hundred Thirty and Noi100
Doliars ($630.00) due and payable prior to May 1, of each year during the term of the lease. Rent
payments are to be mailed or delivered to Landlord's finance o�ce as follows:
