WHEREAS, he Federal, Burgau=•o� Public Roads has directed the Minnesota
HighwayiDepartm�ent to construct a security structure to deter encroachment by
humans or anima}s onto-T.H. 94 and T.H. 35E' in the Ca�itol Approach area before
opening' �hese r?oadways to the pu'�blic in the latter part of 1967; and
WHEREAS, TIhe Commissi ner of I�ighwa�s has prepared plans and a supplemental
agreement for additionalJ£encing construction for Federal P�,ojects identified as
S.P. 6280-96 aid S.P. 6280-97; and ,

WH�REAS, Zhe Oit� Council has previou�ly� approved the original Federal
Projects identified as S;lP. 6280-96 and S.P. 6280-97 by Council Resolutions,
File Numbers� 221850 and 226950; and
�
R,�`� � WH�AS, �opies of the plans for additional proposed temporary fencing are
on file, in thelCity of St. Paul Public Works Department and include, among these
considerations,, that of the closure of the proposed temporary fencing and the
existing bridg� railings top elevations will be the same; and
;
WHEREAS, '�he City and the Minnesota Highway Department have mutually agreed
that the aesthe�tics of the Capitol Approach area would remain unimpaired within
' the reasonable considerations of economics and design; and
�
WHEREAS, he time allowed to review this undertaking was not reasonably
sufficient to evelop in depth a comprehensive master plan by the City for
consideration b,y the Minnesota Highway Department; and

WHEREAS, he City and the Minnesota Highway Department mutually agree to
consider reasonable immediate future removal of objectionable f encing construction
and additional �construction of a security structure as necessary;

_ ,. security of�Traink Highway Number 94 and Number 35E within the City of St. Paul,
