Paul � Sti Paul� Minnesota ' Dear Mr. Mayor and Honorable Members of the Council: i ; � I had intended to be present at the hearing today on th�e widening of I,arpenteur Avenue in St. Paul from East Shore Drive tolWhite Bear Avenue, but a conflict prevents my being at the Council in person so I am stating my position in this letter. � , Sriefly, it is my opinion that the width of Larpenteur Avenue a�t the present time is more than adequate to handle the traffic �west of Prosperity Avenue to East- Shore Drive and any � widening of the width of Larpenteur Avenue, particularly to afford r�ore lanes of travel will be an open invitation to motorists to use L'arpenteur Avenue and this would materially increase trafficlon East Shore Drive and present present and future un- necessary problems with this through traffic. The traffic pro- blems created by this widening would result in a downgrading of the Lak� Phalen park facilities and its surrounding property values. In my opinion the expenditure of tax funds in such a p�roject would be unnecessary, particularly where such funds are so sore�.y needed to solve traffic problems on much more highly traveled city streets. � I am earnestly and sincerely opposed to this contem- plated idening of La.rpenteur Avenue and as a long-time resident of the east side I am unalterably opposed to funneling unnecessary traffia into an area intended for recreation and scenic beauty. DALGLISH, Commissioner LOUIS H.McKENNA,Deputy Commissioner ' Phone:223-4646 I August 15, 1967 ' I � ' � To the Council � Citq of Saint Paul � � i Gentlemen• i � The City Council referred to the Finance Department for a check as to • sufficie�cy the attached petition of remonstrance in connection with Final Order for improving Larpenteur Avenue from East Shore Drive to White Bear Avenue. � � � In checking this petition, we find that certain legal requirements have not been met� Requirements for a petition of remonstrance to be in proper form es presc=ibed by the Citq Charter are as follows: "Such petition shall describe the improvement or improvements andlshall be signed by not less than si$ty percent (60�) of the resident owaers or their agents, of such property aforesaid re- ' presenting not less than fiftq percent (50°/.) of the lineal frontage on the line of such improvement, or when such basis shall be impractical than sixty percent (60�) aforesaid re- presenting not less than fifty percent (50%) of the parcels ' of iand so assessed. ; � "Each signer shall write his name and place of residence or where an agent shall sign the name of such owner by his agent and the place of residence of such owner, give a description of ' the property owned or represented and the lineal foot frontage � of he same when required as aforesaid. ; "Such petition may consist of several papers, but the names on , each separate paper or portion thereof shall be certified to under oath by one of the signers thereof." � i The peti ion doea not give the legal descriptions of property owners and the lineal foot frontage owned by same. Also; the petition is not certified to under oath and notarized as required. Since these conditions have not been met, it is the opinion of this office that the subject petition is not in proper form; and for this reason�the petition has not been checked as to , sufficieacy. Byrne, Mayor ' and Members of the City Council ' C ity of Saint Paul ' : Gentlemen; . � I i � In accordance with the Council 's instructions, a conference has been had with tech�nical representatives from Ramsey County and Maplewood in regard to the Larpenteur Avenue street replacement between East Shore Drive and Clarence . Street aid between Prosperity Avenue and White Bear Avenue. i , Sewer work under a Maplewood contract is presently underway between East Sho��"e Drive and Clarence Street. The letting of additional sewer work, part of the same storm sewer system, .is anticipated in the near future for the arealbetween a point just west of Prosperity Avenue to White Bear Avenue. � � � Undlr the present Maplewoodlcontract the street to be establ �shed follow- ing the �sewer work would have 36 feet of pavement with gravel shoulders and ditches �beyond that. The County people explained that 36 feet is approximately �the average width of formerly existing pavement between East Shore Drive and 'Clarence and that this width various from about 31 to about 44 feet. They 'also stated that the six feet of pavement on either side of the center 24 feet 1is intended to provide walking room for pedestrians and also to be part of a �shoulde�- refuge .for rgency" Istopping. ., ;The additional gravel shoulder �outside�the pavecl area is intended to provide additional convenience to parking or disa led vehicles, as well as being part of a desirable safety space between the tra�eled roadway and the ditches. The people representing Ramsey County , under whose jurisdiction this road is placed indicated that it is their recom- mendation and intention that the ditches be placed as near to the property line as possible and that the back s,lopes would begin at the property line. Drain- age inlets would be placed at various places in the ditches� and connected to the storm sewer. Back slopes would be sodded to blend in with the existing yards. l Revised grading plans 'are now to be prepared in light of the rejec- Ition o the paving plan and the requirement to keep the roadway in a rural Isectio�i. . The County people are confident that existing driveways could be matched in grade. , � � i � - ' ; � . , _ �. _' � I � t � ; ; 'v , ' ,Page 2 .' , ' � - . + t } ' � It i our conclusion that the proposed roadway facility between East Shore Dri�e and Clarence Street Is well planned. It will be confined within the right� of-way, will not involve any assessment and ought not to be changed from what� is now in the Maplewood contract. Judging from statements made at the recent public hearing there may be some objection to the roadway cross- section from the abutting residents who understandably wish to continue the free use �and enjoyment of public lands adjacent to their yards. However, the publiic right-of-way after all is intended for use by, the public for safe vehicular and pedestrian traffic and, of course, it is customarily also used as a drainage catchment for the nearby area. The need for a pedestrian � facilitylis demonstrated by observation along Larpenteur Avenue and also by e petition received several years ago wherein 119 signatories asked for side- walks onithe south side of Larpenteur from East Shore Drive to White Bear � - Avenue. With the �rural section that is now to be installed ordinary side- walks are, of course, not possible in the foreseeable future. It is quite important, therefore, that same walkway provision adjacent to the vehicular �oadway pe provided at this time. , For� the section now under construction from East Shore Drive to Clarence Street, the County is p�reparing a revised grading and drainage plan and we are assured by the M'aplewood engineer that the roadway will be finished as soon as possible. The contract provides for a late October completi�on date, but depending upon the weather it may be necessary to put a temporary surface on for the winter with the final paving to be done next �year. In the meantime, we were assured by the Maplewood representatives �that if any resident has an access problem, he may phone the Maplewood 'engineer or the Lametti � Sons Company, as indicated in our letter recently ;delivered to residents and �make:any temporary arrangements necessary. j I = ; - � From a point just west of Prosperity Avenue to White Bear Avenue the - �County ��uill make� an effort to continue the same section as west of Clarence, �but bec�ause of a possible deficiency of 'fill material on the job it may be � necessa�ry to narrow the graded width somewhat. West of Flandrau a rural � section� with side ditches will be used with the edge grades of the roadway � matching driveways in the vicinity of the property lines. From a point west ofi Flandrau to White Bear �Avenue, the County plans to widen the traveled roadwa� so as to provide additional traffic capacity on the approaches to the signal at the congested White Bear Avenue intersection. Special turn lanes v�ill also be provided. No additional right-of-way would be required west of White Bear Avenue. • ; ' The roadway plans being developed for Larpenteur Avenue appear reason- i abte in scope and to be progressi�g satisfactorily.
