2 WHEREAS, Chapter 293 of the Saint Paul I,egislative Code was enacted to regulate the subject of noise in
3 the City of Saint Paul; and

5 WHEREAS, §293.11 provides for the granring of variances from the sound level limitations contained in
6§293.09, upon a finding by the City Council that full compliance with Chapter 293 would constitute an
7 unreasonable hardship on an applicant, other persons or on the community; and
8
9 WHEREAS, The Saint Paul Saints Baseball Club, represented by Tom Whaley, Executive Vice President,
10 who has been designated as the responsible person on the application, has appliec3 for a variance to allow amplified
ll music at Midway Stadium at 1771 Energy Park Drive, on July 11 and July 29, 2005; and

13 WHEREAS, applicant is seeking a variance for the hours of 6:00 P.M. to 10:45 P.M. for July 11 and July 29
14 2005; and

16 WHEREAS, if applicant is not granted a variance it will not be able to present the amplified music ; and

18 WHEREAS, the Office of License, Inspections, and Environmental Protection has reviewed the application
19 and has made recommendations regarding conditions far the variance; now, therefore, be it
20
21 RESOLVED, that the Council of the City of Saint Paul hereby grants a variance to St. Paul Saints Baseball
22 Club, subject to the foIlowing conditions:

24 1) The variance shall be for the hours of 6:00 P.M. to 10:45 P.M. on July 11 and July 29,
25 2005.

27 2) All electronically powered equipment used in conjunction with the event shall not
28 exceed 100 dBa as measured at the closer of the sound mix or at a distanca of 100 feet
29 from the front of the stage.

2 3) The applicant shall provide personnel and equipment who shall provide continuous
' 3 sound level monitoring at all stages and each sound mix between 6:00 P.M. and 10:45
4 P.M. on both July 11 and July 29, 2005.

6 4) All electronically powered equipment, PA systems, loudspeakers or similar devices shall be turned
7 off no later than 10:45 P.M. on these dates, including all area encompassing this event.
