September 19, 1967 City Council City of St. Paul Gentlemen: � In March, the year of 1961 , I applied for and was granted a building _ permit to build a home on the corner of VanDyke and Wilson Avenue in the City of St. Paul . At that time the Public Works Department had officially established grades on record and also were making plans to introduce orders for the grading of VanDyke Street from Conway Street to Old Hudson Road with certain City Aid Funds made available for this proJect. In order that my house be compatible to the new grade of VanDyke Street, i hired the services of a registered surveyor to set the grade for this building. " This left the front slde of my property approximately 42 to 5 feet above the grade of VanDyke as it existed at that time. Shortly after my home was completed, which was in the year of 1962, the Public Works Department informed me that because of the excessive costs and removal of City funds for this proJect, they did not believe that it would be advisable to int�r.o- duce the order for this costly project at that time. My garage, at that time, was planned to the new grade of VanDyke / Street and 1 am now in a position where it is physically impossibc�e for � me to gain access to my garage. I do feel that as long as I conformed ; to City grades and City rules and regulations that the City has an area of responsibility in this matter. I know, that had I built to the present grade of VanDyke Street when VanDyke was graded, our Va)uations Engineers w�ould have certainly made me an award of damages for damages to my property. For this reason, I feel that the Public Works Department should be given the necessary orders to make a temporary fill so that 1 can gain access to my property or that I should be awarded damages sustained by VanDyke not being graded. I have discussed this problem in detail with Mr. Eugene V. Avery, Chief Engineer for the Department of Public Works and Mr. Grege Beckett, Local Improvement Engineer. They are fully aware of the problem. I might also call your attention to the fact that both Mr. Avery and Mr. Beckett, along with Commissioner Robert Peterson have viewed this site many times and are very well aware of the conditions.
