COUNCIL ES UTION—GENERAL FORM PRESENTED BY - COMMISSIONE � DATE WHEREAS, The Committee on Lands, composed of the Mayor, the Purchasing Agent, and the Commissioner of Public Works of the City of Saint Paul, has secured an agreement for the purchase of that certain property described as follows: The east 41.25 feet of the west 82.50 feet of Lot Five (5) , Irvines Addition of Outlots to the Town of St. Paul,,, except � �the north 101.5 feet, subject to the rights of the public in North Street, and " WHEREAS, The property described therein is necessary for the opening and widening of the Arch-Pennsylvania Highway from Lafayette Road to Payne Avenue, and the price at which the property may be pur- chased is at the total amount of $10,300, a fair and reasonable price according to the appraisal obtained by the Committee on Lands; and WHEREAS, Said Committee has recommended the purchase of said property at the price stated above, as evidenced by the letter of said Committee submitted herewith; now, therefore, be it RESOLVED, That pursuant to Section 303 of the Charter of the City • of'�Saint Paul, the Council of the City of Saint Paul does hereby auth- , orize the purchase of the land described as: \ �, The east 41.25 feet of the west 82.50 feet of Lot Five (5) , Irvines Addition of Outlots to the Town of St. Pau1, except the north 101.5 feet, subject to the rights of the public in i�orth Street; RESOLVED Further that the proper city officials are hereby authorized and directed to pay to Michael F. and Freda E. Fund 6000, to be reimbursed from Bond Fund No. 7200-ST-32, upon their furnishing an abstract of title continued to date evidencing good marketable title in Michael F. and Freda E. Stuhl, and the total payment to be made upon tender by said parties of an appropriate warranty deed conveying title to said ��q���j� the City of Saint Pau1. The owners of the above described lands, Michael F. and Freda E•. Stuhl, have accepted an offer tendered them by the City in the amount of $10,300 as compensation for the sale of the 'said land to the City. This property, including land and buildings, is needed by the City of Saint Paul for right-of-way for the Arch-Pennsylvania Highway. In view of the reasonable price for which it can be purchased, said price being the appraised fair and reasonable market value thereof, we, the Committee on Lands, do recommend to the Council of the City of Saint Paul that it authorize the � purchase of said land in lieu of condemnation proceedings at the price of $10,300 as negotiated with the owners.
