Whereas, In the matter of Comptroller's Contract L-6859 for
� Grading a.nd Pav3.ng 6th STREET from Mounds Boulevard to Arcade
Street, Ashbach Construction Compa�y, Contractor, the specified
date of completion is November l, 1966, and
' Whereas, The Contractor has prosecuted the work diligently '
and completed all of the work included i.n the co�rtract, except
for the seal coat, a.nd since the seal coat work could not be
done at that time of the yeax; therefore be ity
' , Resolved, That the proper City Officials be and they-are
hereby authorized and directed to execute a,n amendment to s.aid
contract extending the time of completion to July l, 1967 provided
however, that this resolution shall have no force or effect unless
the, sureties on the Contractor's bond consent thereto and file
such consent in writing with the City C�mptroller, and be it�
Further Resolved, That the City of Saint Pau1 hereby waives
all claim for liquidated damages a.nd that no engineering and ,
inspection costs on this project wi11 be charged to the Contractor
for such extended period.
