1 WHEREAS, the City of St Paul ("Cit�') has determined that there is no longer a public purpose for
2 owning a parcel of surplus right of way purchased severai yeazs ago for the widening of Pierce Butler
3 Route from 277.2 feet West of Avon Street to Grotto Street, and
5 WHEREAS, the City wishes to vacate its' interest in this property, and
6
7 WHEREAS, the City has received a request from the Deparhnent of Planning and Economic
8 Development ("PED") to convey the properiy to the Housing and Redevelopment Authority of the City
9 of Saint Paul, Minnesota ("HRA") for development of housing, and
10
11 WHEREA5, PED has determined that such conveyance will support public/private development efforts;
12 now, therfore, be it

14 RESOLVED, that, upon the petition of the City of Saint Paul, as described in Real Estate Division File
15 Number 15-2004, the public property hereinafter described in attachment "A" is hereby vacated and
16 disconrinued as public groperty, and be it further
17
18 RESOLVED, that the Council of the City of Saint Paul hereby authorizes the proper City officials to
14 convey the vacated properry by Quit Claim Deed to the HRA.

This vacation shall be subject to the terms and conditions of Chapter 130, codified March 1, 1981, of the
Saint Paul Legislative Code as amended, and to the following conditions:
L That the HRA complete a survey of the subject property and submit said survey to the Public
Works Deparhnent and Real Estate Division;
2. That any expenses incurred, including the $600.00 administrative fee for this vacarion, shall
be paid by the HRA, its successors or assigns; that said expenses shall be due and payable
within 60 days of the effective date of this resolution; and that the IIRA shall reimburse the
City in the amount of the gross proceeds from the sale of said properry described.

photocopies of the Green Sheet, the Council Resolution and a map of the area to be

i WHEREAS, the Housing and Redevelopment Authority of the City of Saint Paul,
2 Minnesota ("HRA") has duly adopted and there is now in legal efFect a City-Wide
3 Redevelopment Plan for the acquisition and rehabilitation and resale of prpperties
4 which plan includes properties in Distri�t 7; and

WHEREAS, NRA recognizes the probfems created by vacant lots and biighting
properties in its neighborhoods not being maintained or being of vatue to the
community, and also recognizes the need to take the initiative to convert these lots into
safe, decent and affordabie home ownership opportunities andlor improve
neighborhood land use; artd
WFiEREAS, the City of Saint Paul supports increased volume in the treatment of vacant
{ots where possible by afl developers inciuding for-profit and nonprofit entities, and with
these objectives in mind, the City needs to assist ofher potential developers of
properties and take fuli advantage of the opportunity to redevelop properties; and
WI-fEREAS, HRA has the power to engage in development or redevelopment activities
under Chapter 469 of the Minnesota Statutes, Housing and Redevelopment Act, and by
authority of said Act engages in activities relating to: 1) housing projects and
devefopment; 2) removal or prevention of the spread of conditions of blight or
deteriorations; 3) bri�ging substandard buildings and improvements into compliance
with public standards; 4) disposition of land for private development; and 5) improving
the tax base and the financia! stability of the community; and
WH�REAS, the Housing and Redevelopment Act gives a specif+c range of powers
including the power to acquire land, seil land, engage in pianning, empioy a variety of
financing instruments, and establish land use controls and additionaily, it requires that
activities be devised according to a pian or program of which fhe Vacant House
Homestead Assistance Program and Replacement Single Family New Construction
Program criteria; and
WHEREAS, the HRA was notified by the City of Saint Paul of the availabifity of a certain
parcel of land located in the City of Saint Paul described as follows:

WHEREAS, the property is vacant and a blighting influence on the surrounding
neighborhood in which it is located; and
WHEREAS, the HRA may acquire the property for no cost; and
WHEREAS, the HRA wi11 reimburse the Gity if it receives proceeds for the sale of the
property; and
WHEREAS, the acquisition of the property in Thomas Dale District 7 area presents
HRA with the oppostunity to acquire a vacant property for resale for housing
development.
NOW, THEREFORE BE iT RESOLVED by the Housing and Redevelopment Authority
of the City of Saint Pauf, Minnesota, that the public acquisition of the property identified
above, which is a vacant fot located within Thomas Dale District 7 area and constitutes
a blighting influence on its neighborhood, is hereby approved in accordance with the
fo{lowing:
That said acquisition of the property under the City Wide Redevelopment Pian
together with Minnesota Statutes 469.012, Subd. 1, 6 and 7 provides for the
acquisition, clearance or rehabilitation of blighting conditions to a(low for housing
for lowfmoderate income families together with acquisition, demolition or
rehabilitation providing improvements to afford maximum opportunity, consistent
with the sound needs of the community as a whole, and providing economic
stability for the area.
2. That pursuant to Chapter 548, Law of Minnesota 1984, it is hereby certified that
said properties meet the condition of Minnesota Statutes Section 272.02,
Subdivision 1, clause (7) and 469.040, Subdivision 1, until sofd for private
redeveiopment are exempt from property taxes.

Half of Block 2, Winter's Addition to Saint Paul, Ramsey County, Minnesota.

on behalf of the Department of Public Works and at the Behest of Planning and Economic
