being that commercial frame building known
and described as 705 Selby Avenue in the
City of Saint Paul and situated upon those
premises legally described as Lot 24, Block
3, Holcombe' s Addition to Saint Paul�
* according to the plat on file and of record
in the office of the Register of Deeds in
and for the County of Ramsey� State of
Minnesota.
WHEREAS, P�a.rsuant to resolution, C. F. 234205� approved
July 7� 1967� a public hearing was duly held on Friday, July 21�
1967, before the Council of the City of Saint Paul� said
hearing pertaining to the condition of the structure located at
705 Selby Avenue� Saint Paul� Minnesota; and
WFiEREAS, Upon the facts presented at the said hearing
consisting of photographs� inspectiox�•reports and the recommenda-
tion of the City Architect, it is found and determined by the '
City Council that according to the records and files in the
office of the Register of Deeds� the last record owner of the �
above-described „property is Sherman Investment Corporation, a
Minnesota corporation; that S and S, Inc. , a Minnesota corpora-
tion, is the mortgagee; according to the records of the County
Treasurer� the named taxpayer is Eugene J. Schway; and that
there are no other lien holders of record; and that it is
further determined that the above-described building constitutes
a hazardous bui�:ding within the definition of Minnesota Statutes
���- Section �+63.15 for the following reasons: t - � �
a. The building has been extensive damaged
by fire, is vacant and apparently aband ed•

b. The wood joists supporting the first
floor show evidence of starting to rot and the
basement area is littered with paper and debris;
c. Approximately 25 per cent of the roof
has caved in and approximately 50 per cent of
the remaining ceiling �oists are extensively
damaged and charred by fire, and the interior
wood bearing wall has also been extensively
damaged by fire; -
d. The interior of the building has been �
burnt out and damaged by heat and water, the
plaster is falling from the walls, the wood
window frames are badly burned� the plumbing�
heating and electrical systems are severely
damaged;
e. The interior of �the building is littered
with combustible material;
f. The building is unfit for use in its
present condition and the above corrections
must be made in compliance with the Building
Code and the Housing Code of the City of Saint
Paul in order to make the building usable;
g. The building is beyond reasonable
� repair;
h. The buiZding constitutes a nuisance and _., �
- a hazard to the p�ublic health� safety and welfare _ ,
. because of its physical damage� dilapidation
and inadequate maintenance; �
now� therefore� be it
RESOLVED� That in accordance with Minnesota Statutes Sections
463.15 through 463.26 and based upon the foregoing findings of the
City Council, the Council of the City of Saint Paul does hereby
make the following Order:

ORDER
l. The owner of the above-described building shall make
the same safe and not detrimental to the public health, safety
and welfare by having the said building razed and the materials
therefrom removed from the premises within twenty (20) days
from the date of the service of this Order or� in the alternative�
begin to correct the building within twenty (20) days of the date
of the service of this Order andw;correct the hazardous conditions
by doing the following:
a. Remove all paper and other combustible
materials from the building and securely close
and keep closed all doors� windows or other
openings in the building;
b. If the building is to be occupied� all
of the above defective conditions must be
corrected and the wiring, plumbing and heating
systems brought up to comply with the Saint
Paul Housing Code and the Saint Paul Building
Code requirements, and that the owner submit
. a list �of intended corrections regarding the
structural condition of the building, electrical ;
and heating system� together with a schedule for
the completion of the rehabilitation program, ��,
and that the owner apply for the necessary
permits in the �ffice of the City Architect � `
' within the twenty (20) days imposed herein. �

2. Unless such corrective action is taken to comply' with
this Order or an answer served upon the City of Saint Paul and
filed in the Office of the Clerk of the District Court of Ramsey
County, Minnesota� within twenty (20) day.s from the date of the
service of this Order, a Motion for Summary Enforcement of this
Order to raze and remove the said building will be made to the �
Ramsey County District Court.
3. In the event that the building is to be razed by the
City of Saint Paul pursuant to �udgment of the District Court,
all personal property or fixtures which may unreasonably inter-
fere with the razing and removal of this building shall be
removed within ten (10) days from the entry of �udgment�; and

if not so removed, the City of Saint Paul shall remove and
dispose of such personal property and fixtures as provided
by law.
4. If the City of Saint Paul is compelled to take any
corrective action herein, a11 necessary costs expended by the
' City will be assessed against the above-described real estate
and collected as other taxes; and be it
FIIRTHER RESOLVED� That a certified copy of this resolution
and incorporated Order herein be served upon the last record
owner of the above described property in the manner provided
by ]aw and also upon other interested parties in the manner
provided by law.

Gentlemen:
� The following is a report from the Bui].ding Department
on the condition of the property located at 705 Selby
in Saint Paul also known as Lot 24, Block 3, Holcombe' s
addition to Saint Paul. The record owner is Sherman
Investment Corporation.
� �+ An inspection made July 13, 1967 indicated the condition
of the property as followss -
The property is a commercial building of concrete block
walls, a wooden frame roof, one story in height, with a
partial basement 40 ft. wide, 100 f t, long and 12 ft. high.
The building was occupied by the Brite-Way Cleaners and
Launderers and was extensively damaged by fire. At the
present time it is being boarded up by the Department of
Public Worlcs as an emergency measure.
BASEMENT
Approximately half the area of the bui�.ding has a basement.
The rest of the building has a slab on grade. The wood
� joists supporting the first floor show evidence of starting
to rot and the basement area is littered with paper and
other debris.
FIRST FLOOR
Approximately 25 per cent of the roof has caved in and
50 per cent of the remaining ceiling joists are extensively
damaged and charred by fire. T'he interior wood bearing
wall has also been extensively damaged by fire. '

The portions of the interior that were not damaged by
fire were extensively damaged by heat and waterr The
plaster is falling from the walls, the wood window frames
are badly burned and it is the opinion of this department
that the building is beyond reasonable repair. The fire
damage is so extensive that it does not appear that the
plumbing, heating or electric systems are serviceable.

Therefore, it is necessary that the property be secured
so as to prevent entrance by unauthorized persons and all
combustib�e materials be removed from the interior of this
structure. If this alternative is not taken, it is the
conclusion of the Bureau of Public Buildings that be reason
of inadequate maintenance, dilapidation, physical damage,
unsanitary condition and abandonment, this building
constitutes a hazard to public hea,lth,. safety and welfare.
