1 WHEREAS, the City of Saint Paul, on behalf of Northern States Power Company, d..b.a. Xcel
2 Energy, Qwest Corporation and MCI Worldcom Network Services, Inc. retained easement rights in
3 the vacated portion of Rice Street approved in CF# 03-996 on November 11, 2003 (as amended in
4 CF#04-418 on Apri121, 2004), and
5
6 WHEREAS, based upon the Certificates of Intended Non-Use filed voluntarily on behalf of said
7 Northern States Power Company d.b.a. Xcel Energy, Qwest Corporafion and MCI Worldcom
8 Network Services, Inc., the City of Saint Paul requests the release any remaining easement rights held
9 by the above-mentioned utilities, except as noted in the Certificates, so
10
11 THEREFORE BE IT RESOLVED, the City of Saint Paul does hereby release the easements rights
12 held by Northern States Power Company d.b.a. Xcel Energy, Qwest Corporation and MCI Worldcom
13 Network Services, Inc., and
14
15 BE IT FURTHER RESOLVED, that all other terms and conditions of CF# 04-456 shall remain in full
16 effect.

2 Division File Number 14-2003, public properties hereinafter described are hereby vacated and
3 discontinued as public properry:

8 right-of-way line of Larpenteur Avenue and the westerly extension of the south
9 line of Lot 13, Block 1, Merrill's Division of Rice Street Villas described as follows:

11 Commencing at the northwest corner of 3ection 19, Township 29, Range 22, Ramsey County,
12 Minnesota; thence easterly along the north line of said Section 19, 53.00 feet to the point of
13 beginning of a line to be described; thence southerly pazallel with the west line of said Section
14 19, 53.00 feet, thence westerly at right angles, 7 feet; thence southerly pazallel with said west line
15 to the westerly extension of the south line of said Lot 13, thence easteriy along said westerly
16 extension to the southwest comer of said Lot 13 and the point of termination.

T'his vacation shall be subject to the terms and condition of Chapter 130, codified Mazch 1, 1981, of the
Saint Paui L.egislative Code as amended, and to the following conditions:

That the petitioner's, their successors and assigns shall pay $1,200 as an administrative fee for

That a permanent utility easement shall be retained within the vacated azea to protect the interest
of Qwest Corporation
That a permanent utility easement sha11 be retained within the north 10 feet of the vacated area to
protect the interest of Northem States Power Company, d.b.a. Xcel Energy.
That a permanent utility easement shall be retained within the vacated area to protect the interest
of MCI Network.

That the pedtioners, their successors and assigns agree to indemnify, defend and save hazmlessV�'
the City of Saint Paul, its officers and employees from all suits, acuons or claims of any character
brought as a result of injuries or damages received or sustained by any person, persons or
properry on account of this vacation or petitioners' use of this properry, including but not limited
to, a claim brouaht because of any act of omission, neglect, or misconduct of said peutioners or
because of any claims or liability arising from any violation of any law or regulation made in
accordance with the law, whether by the petitioners or any of their agents or employees.
6. That the petitioners, their successors and assigns shall, within 60 days of the effective date of this
resolution, file with the City Clerk an acceptance in writing of the conditions of this resolution
and shall, within the period(s) specified in the terms and conditions of this resolution, comply in
all respects with these terms and conditions.
