2 WHEI2EAS, an examination of the present RT-1 zoning classification of certain lots in
3 that area of the City generaliy within the boundaries of Stillwater Avenue on the North, Howard
4 Avenue on the East, Bush Avenue on the South and Waukon Avenue on the West and more fully
5 described as shown on the zoning map attached hereto and incorporated herein by reference as
6 Exhibit 1, shows that these lots aze zoned RT-1 which pernuts the construction of two-family
7 dwellings; and
9 WHEREAS, with the exception of two lots which abut Stillwater Avenue jalong the
10 northern edge of Exhibit 1], the lots shown in Exhibit 1 are presently undeveloped and have

remained that way for a considerable period of time; and
WHEREAS, the lots abutting the area described in Exhibit 1, as well as the overall areas
suirounding these lots, have been given either an R-3 or R-4 zoning classification which limits
development on these lots to one-family dwellings; and
WHEREAS, an examination of the patterns of development for both the lots abutting
Exhibit las well as the lot sunounding the area Exhibit 1, demonstrate that this azea of the City
has been developed, in large part, with single family homes; and
WHEREAS, the recent examination by the Board of Zoning Appeals of two zoning
applications for variances requested for the ptupose of converting existing one-family dwellings
located on separate lots in the 2100 block of Stillwater Avenue into two-family dweilings,
together with the number of undeveloped RT-1 zoned lots depicted in Exhibit No. 1, lead this
Councii to conclude that development of this pocket of RT-1 lots with two-family dweilings, in
an azea virtually surrounded by lots zoned R-3 or R-4 and developed with one-family dwellings,
may result in uses which are not consistent or compatible with either the already established
pattern of development in this neighborhood or the development goals of this area of the City
under its current comprehensive plan; and
WHEREAS, the potential far incompatible or inconsistent development of the subject
RT-1 parcels raises substantial questions relating to the ability of the present official controls
and comprehensive plan to assure that any development of the subject pazcels will be undertaken
in a manner whach reflects and is compatible with the present patterns af development in this
azea as well as a future vision for development of this area; and

2 WHEREAS, in order that any future development or use of these RT-1 zaned pazcels
3 may take place in a manner which reflects the essential chazacter of this neighborhood, protects
4 already established property values within the neighborhood and provides an updated and overall
5 vision for the development of the large undeveloped parcel of RT-1 zoned land shown in Exhibit
6 1, the City's present official controls and comprehensive plan for this area must be reassessed,
7 reevaluated and restated; and

WHEREAS, a study by the City's Planning Commission of the RT-1 zoned lots shown
in Exhibit lis therefore necessary to insure that these parcels of land will be developed in a
manner which will meet the needs of the City as described above; NOW, THEREFORE
BE TT RESOLVED, that the Council of the City of Saint Paul finds, with respect to the
present land use classification, official controls and comprehensive plan for the RT-1 zoned ]ots
described in Exhibit 1, that there is a need to preserve the status quo of these lots for the purpose
of protecting the general health, welfaze and safety of the public pending the conclusion of a
study of the said lots by the City's Planning Commission; AND, BE IT
F[3ItTHER RESOLVED, that the Planning Commission's study of the lots described in
Exhibit lshould analyze the future development opportunities, zoning options and official
controls and make recommendations accordingly for any amendments to the City's official
controls and comprehensive plan; AND, BE IT
FURTHER RESOLVED, that pending the adoption of any recommendations by such
study to amend the City's official controls and comprehensive plan s, the issuance or approval of
zoning and building pernuts, plat approvals or lot splits are hereby immediately prohibited
subject to any exceptions which may be indicated by separate resolution, by amendment to an
interim ordinance of the City Council or for any subdivision application that has been given
preliminary approval on any parcel of land or part thereo£ wathin the boundaries above described
in Exhibit 1, until such time as the aforementioned study has been completed and reported and
the City Council has taken action on any recommendations arising therefrom until the expiration
of 12 months as provided in Minn. Stat. § 462355, Subd. 4 or until such earlier rime as the City
Council has taken action on the recommendations contained in the study; AND, BE IT

FURTHER RESOLVED, until such time as the said study has been completed and
acted upon by the City Council, City departments receiving written requests for the approvals
noted herein shal] accept complete requests and immediately process such requests in accordance
with the provisions of Minn. Stat. § 15.99, Subd. 2 and consistent with the intent expressed in
this resolution and accompanying interim ordinance; AND, BE IT
FINALLY RESOLVED, that the moratorium provided for herein, shall be enacted as an
interim ordinance pursuant to Minn. Stat. § 462355, Subd. 4 under a separate ordinance adopted
in conformance with the City Charter, Chapter 6, but for the computation of the duration of the
interim ordinance, the effecrive date of the interim ordinance is the same as the effective date this
resolution.
