WfIEREAS, Neighborhood Housing and Property Improvement (NHPI) has requested the City
Council to hold public hearings to consider the advisability of revoking the rental rea stration certificate
for a single family rental property located at 123 COOK AVE W and registered to Cynthia S. Boisen ;
and
WHEREAS, on Aprii 7, 2004, NHPI conducted an inspection of said property and issued a
Correction Notice with a compliance deadline of June 30, 2004; and
WHEREA5, on November 2, 20Q4, NfIPI conducted a reinspection of said properiy and found
lack of compliance with the previous order; and
WHEI2EAS, on November 15, 2004, NHPI sent the holder of the rental registration certificate for
the subject properiy, Cynthia S. Boisen , a$50 excessive consumption bill, addressed to 3408 Cloman
Way E, Inver Grove Heights MN 55076-1647, the address on said certificate; and
WHEREAS, as of February 4, 20Q5, said $50.00 has not been paid, and Legislative Code §S1.Q6
(a) (v) provides thaf non-payment of fees for excessive consumption is grounds for certificate
revocation; and
WHEREAS, on November I5, 2004, NHPI notified Cynthia S. Boisen of the need to arrange an
interior inspection of the subject properiy; and
WHEREAS, as of February 4, 2005, an interior inspection has not been ananged, and Legislative
Code §51.07 (a) (iii) provides that the imposition of an excessive consumption fee is grounds for an
interior inspection; and
WHEREAS, on January 20, 2005, NHPI sent Cynthia S. Boisen the proper Notice of Intent to
Revoke Rental Registration (copy attached); and
WHEREAS, Cynthia S. Boisen has not appealed said notice and the time for filing an appeal has
expired; now therefore
BE IT RESOLVED, that based on the foregoing, the Saint Paul City Council hereby adopts the
following findings and order concerning the subject properry at 123 COOK AVE W.
That the subject property is a single family rental property that is required to be registered
with the City's Rental Registration Progranl.

Ttiat said certificate holder has been billed for excessive consumption of code inspection
services, which has not been paid.
That said certificate holder has been requested to allow an interior inspection of the
subject property, which has not been arranged.
That the notifacation requirements of Chapter 51 have been fulfilled and the time for an
appeal has expired without an appeal being made.
ORDER
The Saint Paul City Council hereby makes the following order:

The above-referenced Rental Registration Certificate issued to Cynthia S. Boisen for the
single family rental property at 123 COOK AVE W, Saint Paul, MN is hereby revoked.
It is further ordered that a copy of this resolution be mailed to Cynthia S. Boisen .

I am writing to you in your capacity as the holder of a rental registration certif'icate for 123 COOK AVE W, St.
Paul MN.
You are hereby notified, pursuant to the authority p�anted to me under Chapter S 1 of the St. Paul Legislative
Code, of the City's intent to revoke the registration certificate for 123 COOK AVE W based on the foliowing:
On Apri17, 2004, this department conducted an inspection of said property and issued a
Correction Notice with a compliance deadline of June 30, 2004

On November 2, 2004, this department conducted a reinspection of said property and found lack
of compliance with the previous order.
On November 15, 20Q4, this department sent you a$50.00 bill for the cost of said reinspection.
As of today this $50.00 has not been paid.
On November 15, 2004, this department notified you by mail of the need to arrange an interior
inspection of said rental property.
As of today this interior inspection has not been arranged.
I have referred this matter to the St. Paul City Council with a recommendafion to revoke the rental registrarion
�ertificate. The City Council will revoke unless an appeal is filed in the next thirteen {13) days from the date of
his notice. An appeal may be filed pursuant to legislative Code § 18,02, by appearing in person between the
iours of 8:00 am. and 4:34 pm. on any business day at the City Clerk's Office, Room 170, City Ha11,15 W.
�eliogg Boulevard, St. Pau1, MN or you may appeal by mail within the same 13 day time line.
)nce the City Council has revoked the rental registration certificate, occupancy of the property is not allowed
ntil (1) an inspection byNeighborhood Housing and Properry Improvement (NHPI) has been conducted, (2)

the Director of NHPI has determined the property to be in compliance, and (3) the certificate is renewed. Note:
Renting a property without a certificate is a misdemeanor.
Please call me as soon as possible to arrange a meeting to discuss how to correct this situation before the City
Councii acts to revoke this certificafe. If all issues are addressed, I will recommend that the revocation be
withdrawn from consideration by the City Council.
